Dr Fidelma White participates in the Third Roundtable on Unfair Trading Practices in Business-to-Business Relationships in the Agricultural and Food Supply Chain in Leuven

16 Jan 2023

The issue of unfair trading practices between businesses in the agricultural and food supply chain has been on the national and EU policy agenda for some time.

On 13th January 2023, F.White participated in the Third Roundtable on unfair trading practices in business-to-business relationships in the agricultural and food supply chain in Leuven, Belgium.

The issue of unfair trading practices between businesses in the agricultural and food supply chain has been on the national and EU policy agenda for some time now.  More recently, in 2016, legislation in the form of the Consumer Protection Act 2007 (Grocery Goods Undertakings) Regulations 2016 (S.I. No. 35 of 2016) was introduced only to be surpassed by the European Union (Unfair Trading Practices in the Agriculture and Food Supply Chain) Regulations 2021 (S.I. No. 198 of 2021) which transpose Directive (EU) 2019/633 on unfair trading practices in business-to-business relationships in the agricultural and food supply chain (‘UTP Directive’).  As a minimum harmonisation directive, Directive 2019/633 leaves discretion to member states to enhance levels of protection.

The Minister for Agriculture has recently introduced the Agriculture and Food Supply Chain Bill 2022 in the Oireachtas with a view to enhancing protection in Ireland.

The Third Roundtable was convened with a view to critically assessing the national implementations of UTP Directive in all EU Member States and the UK, and examine the similarities and differences of these regimes.
