Forthcoming Book: European Preventive Restructuring: An Article-by-Article Commentary

Professor Irene Lynch Fannon, PI of the JCOERE Project, has contributed to the publication of a co-edited edited book on European preventive restructuring, entitled “European Preventive Restructuring: An Article-by-Article Commentary".

Published by Beck, this forthcoming book is co-edited by Christoph G Paulus and Reinhard DammannThe book will be published in Janary 2021.

The commentary provides an analysis of the European Preventive Restructuring Directive  (Directive 2019/1023) (PRD), which must be transposed into national Member State legislation by 26th June 2021.

A team of European-wide recognised, experienced insolvency law experts, some of whom had been involved in the drafting process of the Directive, analyse the Directive article by article. The authors focus not only on the officials tasked in the national surroundings with drafting the national statutes but also on the wider implications which, one way or the other, will be national law. The commentary, thus, serves also the purposes of practitioners and judges in the field of restructuring.

Professor Lynch Fannon has authored Chapters on Articles 13, 17 and 18 of the Preventive Restructuring Directive in the book. 

Article 13 of the PRD pertains to workers rights. 

Articles 17 and 18 of the PRD set down provisions for the protection of new and interim financing and for the protection of other restructuring related transactions, respectively.
