Coimisiún na Meán – Broadcasting complaints and UCC98.3FM
Any listener who is not happy about content on an Irish radio broadcasting service has the right to complain and have that complaint handled under the process overseen by Coimisiún na Meán. The Commission is responsible for considering and deciding on broadcasting complaints under the Broadcasting and Other Media Regulation Acts 2009 and 2022 and the relevant broadcasting codes and rules.
How to make a complaint
Make your complaint to the broadcaster first. This is the quickest route and the broadcaster must have a published Code of Practice for Complaint Handling.
All complaints must:
- be in writing to the broadcaster
- be made within the statutory time limits:
- one broadcast: within 30 days of the date of the broadcast
- two or more unrelated broadcasts: within 30 days of the earliest broadcast
- related broadcasts on different dates: within 30 days of the latest broadcast
- relate to an Irish radio broadcaster
- fall within the relevant statutory standards and/or broadcasting codes and rules
- include enough detail for the content to be identified and assessed, typically: your name and contact details, programme title, service, date and time, the standards you believe were breached, and why you believe they were breached
If you are not satisfied or get no reply
If the broadcaster’s response does not address your complaint, or if they fail to respond within the timeframe in their Code of Practice (usually 20 working days), you may refer the complaint to Coimisiún na Meán within 14 days of the broadcaster’s reply or of the date a reply was due. You can submit via the Commission’s online form or by post.
What Coimisiún na Meán publishes and privacy
The Commission publishes notices of complaint decisions on its website. These notices include details such as programme title, service, dates and the decision. The Commission does not publish your name or contact details in these notices. Personal data is handled in line with the Commission’s privacy statement, and FOI may apply to some records subject to legal exemptions.
Decision timelines
Once a valid complaint is with Coimisiún na Meán, the Commission makes its decision within 60 working days and notifies you within 30 days of that decision.
