The environmental action of children/youth and its impact on human rights law

The Intergovernmental Panel on Climate Change outlined in 2022 that the failure of humanity to curb the climate crisis has already guaranteed irreversible damage to the earth (IPCC, 2022). Devastating impacts will be caused to the health and well-being of children due to associated phenomena such as mass migration, global heating, air pollution, severe weather events, increased transmission of infectious diseases, food and water shortages, and rising sea levels. The threat of climate crisis is disruptive on many levels, but particularly in terms of demonstrating the power that children’s action can have. Children and young people have frequently been drivers of change in their communities, for example in apartheid South Africa and other instances of injustice around the world. In the climate crisis however they have organised on a global scale, bringing much-needed media attention to the issue; speaking in national parliaments; and engaging in climate litigation. These activities have driven exciting developments in international human rights law. This chapter examines the influence of child and youth environmental action in this space, including through the lens of Two of the authors who were Young Advisors for the drafting of general comment 26 of the UN Committee on the Rights of the Child, on the right to a healthy environment.
