Module Objective: To provide an understanding of the operation of the Irish legal system and to understand the connection between common law and statute law and appreciate the manner in which law relating to occupational safety and health has developed.
Module Content: The evolution of health and safety legislation over the last 150 years with special reference to the Safety, Health and Welfare at Work Act 2005. The Irish legal system; organisation of the court system; Common Law; Statute Law; European Union Law; Health and Safety Legislation.; Planning and encironmental laws; the incorporation of relevant health and safety law into organisations' health and safety policies and management systems.
Learning Outcome: On successful completion of this module, students should be able to:
  • Describe the manner in which the law relating to occupational health and safety has developed over the past 150 years
  • Describe the operation of the Irish Legal system in relation to occupational safety and health
  • Identify the connection between common law and statute law in relation to occupational safety and health
  • Outline the Safety, Health and Welfare Act 2005 and subsequent regulations
  • Advise management on employment law relating to places of work
  • Implement statutory work place regulations
  • Interpret and apply legislative requirements in workplace settings.
  • List the enforcement procedures relating to the occupational health and safety procedures
  • Describe the nature of change to legislation particularly influenced by developments at a European and international level.
Assessment: Total Marks 100: Continuous Assessment 100 marks (1 x 2,500 word case study (100 marks)).
Compulsory Elements: Continuous Assessment.
Penalties (for late submission of course/project work etc.): Where work is submitted up to and including 7 days late, 5% of the total marks available shall be deducted from the mark achieved. Where work is submitted up to and including 14 days late, 10% of the total marks available shall be deducted from the mark achieved. Work submitted 15 days late or more shall be assigned a mark of zero.
Pass Standard and any Special Requirements for Passing Module: 40%.
End of Year Written Examination Profile: No Formal Written Examination.
Requirements for Supplemental Examination: Marks in passed element(s) of Continuous Assessment are carried forward, Failed element(s) of Continuous Assessment must be repeated.
