Statute XXVI.

Irish Universities Act, 1908

University College, Cork

We, the Governing Body of University College, Cork, under and by virtue of the powers in that behalf conferred on us by the said Act, Do by this present instrument under the Seal of University College, Cork, make the Statute contained in the Schedule hereof for the general government of the said College.

Given under the Common Seal of University College, Cork, this nineteenth day of May, One Thousand Nine Hundred and Thirty-one.

Statute XXVI.

Schedule

CHAPTER I.

  1. Statutes I to XXV. of University College, Cork, Shall be read and construed with the additions and modifications as hereunder set forth.
  2. There shall be in the College (in the event of such a Lectureship being instituted within the College by the Senate of the National University of Ireland) in addition to the Lectureships mentioned in Statutes I. to XXV. of University College, Cork:

    A Lectureship in Clinical Pathology.

  3. The salary of the said Lectureship shall be £350 per annum.
  4. The said Lectureship shall not be deemed to be a full-time Lectureship within the meaning of the Statutes.
  5. The said Lectureship shall he tenable upon the same conditions, and the holder thereof shall be subject to the same duties and obligations, as if the said Lectureship had been included in Statutes I. to XXV of the College.
  6. This Lectureship is in lieu of the Senior Assistantship in Clinical Pathology heretofore existing in the College and the said Assistantship shall cease to exist on the appointment being made to the said Lectureship.

CHAPTER II.

Chapter XXII. of Statute I. is hereby revoked and the following shall be substituted therefor:

The Librarian.

  1. The Librarian shall, subject to good conduct and the due fulfilment of the duties of his office, be entitled to hold office until he shall have attained the age of sixty-five years. After attaining the said age, a Librarian may be continued in office by the Governing Body from year to year, for a period not exceeding five years.

    Provided that such further continuance in office is recommended to the Governing Body by the President.

  2. The Librarian shall receive a salary of £450 a year rising by annual increments of £25 to £550 a year.
  3. The Librarian shall devote his whole time to the duties of his office, and shall attend at the Library at such times as the Governing Body shall prescribe.
  4. The Librarian shall discharge the duties of his office which shall be prescribed by Regulations, and shall do and perform all other acts and duties in relation to the College as by the Statutes or Regulations he may be required to do or perform.
  5. The said Librarianship shall be a pensionable office in accordance with Statute XVI., and Chapter II. of Statute XXIV., and the Pension Scheme annexed.

CHAPTER III.
Provision of Payments and Pensions to the Non-Statutory Full-time Members of the Staff and to the Wages Staff.

  1. Out of the Income granted for the maintenance of the College under the University Education (Agriculture and Dairy Science) Act, 1926, Sec. 11 (1), or out of the moneys of the College applicable thereto an annual sum of £750 shall be set apart as from the 1st August, 1931, to provide a fund for the above purpose.
  2. The Governing Body is hereby authorised to pay a pension to any full-time employee who is in the service of the College at the age of 65 or over and has had 20 years' continuous service.
  3. The amount of the said pension shall be at the sole discretion of the Governing Body, but shall not exceed two-thirds of the employee's salary or wages.
  4. Any employee of the College who shall not be pensionable under the various schemes of the College pursuant to Statutes XVI. and XXIV., and shall have had over twenty years' continuous Service and who has not reached the age of 65 years, but who from age, ill-health, or other incapacity from infirmity of mind or body, shall cease to hold Office or employment in the College, shall be granted such pension as the Governing Body at its absolute discretion shall think fit, but such pension shall be paid only out of the funds set aside under this Statute.
  5. Any employee of the College who shall not be pensionable under the various schemes of the College pursuant to Statutes XVI. and XXIV., with less than twenty years' continuous service, and who from age, ill-health or other incapacity from infirmity of mind or body shall cease to hold office or employment in the College, and shall be found to the satisfaction of the Governing Body to be in urgent need of assistance, may be granted, at its absolute discretion such sums or sum of money (not exceeding on the whole, one year's salary or wages) as a gratuity ; but such grant shall be made only out of the funds set aside under this Statute.
  6. In the case of the death during tenure of office or employment of an employee of the College who shall not be pensionable under the Pension Schemes of the College as per Statutes XVI. and XXIV., but who shall not have had less than twenty years' continuous service, the Governing Body may, at its absolute discretion, grant to the dependents of the deceased employee a sum of money (not exceeding one year's salary or wages) as a gratuity ; but such grant shall be made only out of the funds set aside under this Statute.
  7. No gratuity shall be made or pension granted, by the Governing Body until it has received and considered a report thereon from the Finance Committee of the College.
  8. All unexpended balances, interest and dividends may be invested by the Governing Body in accordance with the Statutes of the College.
  9. After due inquiry as to the amount necessary for the requirements of this Fund, any excess amount may be transferred by the Governing Body and be applied to the general purposes of the College.
  10. Nothing in this Statute shall be considered to revoke or restrict the power granted to the President under Chapter IV. Sec. 12 of Statute I., viz.

    " He shall have the power of appointing, suspending and dismissing the servants of the College, and shall regulate their duties and control their conduct. "

  11. This Statute shall be construed with and as part of Statutes I. to XXV. of University College, Cork, and may he cited as Statute XXVI. of University College, Cork, or Stat. XXVI. of Univ. Coll., Cork.
  12. This Statute shall come into operation on the. Twentieth day of May, One Thousand Nine Hundred and Thirty-one.
