Statute XX.

Irish Universities Act, 1908

University College, Cork

Whereas His Late Majesty King Edward the Seventh was graciously pleased, in pursuance of the provisions of the Irish Universities' Act, 1908, to constitute and found a new University having its seat in Dublin, and to direct that the said University should bear the name of the National University of Ireland.

And Whereas by sub-section (3) of section 2 of the said Act, Queen's College, Cork, the name of which his said late Majesty was graciously pleased, in pursuance of the said sub-section, to alter to University College, Cork, is a constituent College of the, said University.

And Whereas by section 4 of the said Act, the Statutes for the general government of the constituent Colleges of the said University were directed to be made in the first instance by the Dublin Commissioners appointed under the said Act, and after the powers of the said Dublin Commissioners determined by the governing bodies of the said constituent Colleges.

And Whereas the said Dublin Commissioners under and by virtue of the powers conferred upon them by the said Act. duly made a Statute for University College. Cork (to be cited as Statute I. of University College, Cork) given under their Common Seal, bearing date the 15th day of April, 1911.

And Whereas the powers of the said Dublin Commissioners determined on the 31st day of July, 1911.

And Whereas We, the Governing Body of University College. Cork, did on the 4th day of March, 1927, by resolution, provisionally adopt the Statute (to be cited as Statute XX. of University College, Cork) set out in the Schedule hereof.

And Whereas a copy of said Statute was communicated on the 5th day of March, 1927, to the Academic Council of the said College.

And Whereas the Faculty of Science of the said College has had an opportunity of pronouncing an opinion upon the proposed changes.

And Whereas We, the said Governing Body, have considered any representations on the subject of said proposed Statute, made to us by the said Academic Council, within two months from the said 5th day of March 1927, and have by a resolution adopted at our meeting held this 3rd day of June, 1927, by a majority of the Members of the said Governing Body now holding office confirm the resolution to make the said Statute with certain amendments.

And Whereas a copy of the said Statute has, at least, seven days before the said 3rd day of June, 1927, been sent to each Member of the Governing Body, to the Registrar of the National University of Ireland, and also to the Secretary of University College, Dublin and to the Secretary of University College, Galway.

Now We, the Governing Body of University College, Cork, under and by virtue of the powers in that behalf conferred on us by the said Act, Do by this present instrument under the Seal of University College, Cork, make the Statute contained in the Schedule hereof for the general government of the said College.

Given under the Common Seal of University College, Cork, this Fourth day of June, One Thousand Nine Hundred and Twenty Seven.

Statute XX.

Schedule

CHAPTER I.

  1. In pursuance of the provisions of the University Education (Agriculture and Dairy Science) Act, 1926, Section 13, a Faculty of Dairy Science is established in University College, Cork.

  2. The stipends of the Professorship and Lectureships instituted by Statute XXXIV. of the National University of Ireland in University College, Cork, in the Faculty of Dairy Science, shall be as follows:

    PROVIDED that in the case of the holder of the Professorship of Agriculture instituted by Stat. XIII., National University of Ireland, by Stat. XII. and Stat. XVII., Univ. Coll., Cork. before appointed to the professorship of Agriculture above cited, the Professorship instituted by Stat. XIII., Nat. Univ. Ireland, and Statutes XII. and XVII., Univ. Coll., Cork, shall be hereby abolished.

    PROVIDED also that if the holder of the Professorship of Agriculture instituted by Statute XIII. National University of Ireland is appointed to the professorship of Agriculture above cited, the stipend and additional remuneration shall be paid to the said Professor as from the 1st October, 1927, any payments already made to the said Professor by the College being deducted therefrom.

  3. The Professorship and Lectureships above set forth shall be Full-Time Professorship and Lectureships.

  4. The stipends of the said Professorship and Lectureships shall be provided out of the moneys paid to University College, Cork, for the purpose of a Faculty of Dairy Science, by the University Education (Agriculture and Dairy Science) Act, 1926, Section 13, and not out of the endowment provided for University College, Cork, in Section 11 of the said Act, nor out of the General College Funds. No bonus shall be paid as an addition to the stipends of the said Professorships and Lectureships.

  5. The said Professorship and Lectureships shall be tenable upon the same conditions and the holders thereof shall he subject to the same duties and obligations as if the said Professorship and Lectureships had been instituted by Chapter XIII. of Statute I., University College Cork. The salaries of the said Professorship and Lectureships shall be paid monthly.

  6. The Professorship and Lectureships set forth in this Chapter are pensionable offices, and the pensions payable to the holders of the said Offices shall be in accordance with the provisions in Chapter II. hereof.

    The holders of the Professorship and Lectureships set forth in this Chapter shall not be entitled to pensions or bonus payable out of the funds of University College, Cork, under Statutes XI., XIII., and XVI., University College Cork.

  7. Notwithstanding the provisions of Statute I. Chapter XI., Section 8, University College Cork the holder of the said Professorship of Agriculture shall act as Dean of the Faculty and shall be responsible generally for the co-ordination of the work in the several subjects mentioned in Section (2) hereof and of the Faculty. He shall also be Director of the College Farms, and shall be responsible for their management and business, and shall have the power of general supervision of the institutions connected with the farms. He shall regulate the allotment of the Laboratories in this Dairy Institute and Model Dairy and shall appoint the hours of Lectures and of Practical Instruction, and shall regulate the facilities which may be required on the farms for the pursuit of research in the several departments of instruction embraced within the Professorship and Lectureships set forth in this Chapter.

In addition to the remuneration attached to the Professorship of Agriculture, a sum of £100 a year shall be paid to the Professor of Agriculture in respect of his services as Director of the Farms.

CHAPTER II.

There shall be paid annually out of the endowment for the Faculty of Dairy Science in University College, Cork, provided by the University Education (Agriculture and Dairy Science) Act. 1926, Section 13. an annual sum, at the rate of ten per cent. of the sum appointed as the stipend of each of the pensionable offices mentioned in Chapter I., for the provision of a pension at clue retiring age for the holders of said Offices and a pension scheme shall hereafter be made by clue College by Statute, which shall determine the benefits to he provided. The moneys already paid into the Additional Pension Fund on account of the Professor of Agriculture referred to in the Statute XII., Section I, and Statute XVII., Section 2, shall be transferred to this Fund.

CHAPTER III.

Regulations made by the Governing Body shall, from time to time make provisions for the appointment of Assistants to aid research and teaching, and Demonstrators in the several subjects of instruction embraced within the Professorship and Lectureships cited in Chapter I., and shall prescribe the tenure and salaries of such.

The qualifications in scientific knowledge of persons appointed as such assistants may be either in one of the branches of General Science or in a branch of Agricultural Science.

The remuneration of such persons shall be paid out of the endowment provided for the Faculty.

CHAPTER IV.

Within the resources offered by the endowment of the Faculty, further Professorships and Lectureships in the several subjects cited in Chapter 1, or in cognate subjects in lieu of Lectureships therein established or otherwise, may be established if thought fit, subject to the rights of the holders of the offices established by Chapter I, of this Statute, and provision may be made, with the growth of the Faculty, for the establishment of Assistantships, whether in association with Research Assistantships or otherwise.

CHAPTER V.

Departmental and general maintenance, including service, for the work of the subjects of instruction embraced within the Professorship and Lectureships cited in Chapter I., and the extensions thereof cited in Chapter IV., and for the work of the College Farms, and for the salaries, wages, and allowances, if any, of the persons employed therein and all other charges arising, shall be charged on the endowment and other receipts of the Faculty.

CHAPTER VI.

The accounts of the application and expenditure of the endowment provided for the Faculty of Dairy Science by Section 13 of the University Education (Agriculture and Dairy Science) Act, 1926, and of the receipts proper to those accounts shall be kept, and shall be rendered by the College as a separate account, and shall not he merged in the general accounts of the College, hut in other respects the accounts of the Faculty of Dairy Science shall be managed as provided by Statute I., University College, Cork, for such general accounts as aforesaid.

CHAPTER VII.

DATE OF COMING INTO OPERATION AND MODE OF CITATION

  1. This Statute shall come into operation on the Fourth day of June, One Thousand Nine Hundred and Twenty-seven.

  2. This Statute shall be construed with and as part of said Statutes I. to XIX. University College Cork, and may be cited as Statute XX. of University College. Cork, or Stat. XX., Univ. Coll., Cork.
