University College, Cork

We, the Governing Body of University College, Cork, under and by virtue of the powers in that behalf conferred on us by the said Act, Do by this present instrument under the Seal of University College, Cork, make the Statute contained in the Schedule hereof for the general government of the said College.

Given under the Common Seal of University College, Cork, this tenth day of March, 1992.

Statute 160.

Schedule

Statutes 1 to 159 of University College, Cork shall be read and construed with the additions, modifications and amendments hereinafter set forth.

CHAPTER I.
Pension Scheme

1. The Pension Scheme annexed to Statute 79, as already amended, is hereby further amended in accordance with the provision set out in this Chapter.
2. Clause 26 of said Scheme shall be deleted and replaced by the following:

   "26. A widow's pension shall cease on her death or re-marriage but may, at the discretion of the Governing Body, be restored on subsequent widowhood or if compassionate grounds for doing so subsequently arise; it shall also cease on cohabitation".

CHAPTER II.
Contributory Spouses and Childrens Pension Plan

Statute 108, Chapter IV., as already amended, is hereby further amended as follows:

• (1) by the addition to section 10(a), after the words "years of pensionable service", of the following:

  "as it would have been enhanced under the terms of Clause 17(b) of the Pensions Scheme annexed to Statute 79, had the deceased participant been required to retire under the terms of Clause 17(a) of said Scheme at the date of death".

• (2) by the addition of the following to section 11(a): "iii. notwithstanding the provisions of paragraph ii of this subsection, participants may make contributions, under a scheme to be determined by the Pensions Committee, at the rate of one and a half per cent of current salary for each year in respect of which contributions would be payable at date of retirement or earlier death in lieu of all or part of the deduction that would be payable under the terms of paragraph ii".

CHAPTER III.
Preservation of Pensions

Statute 108, Chapter V., as already amended, is hereby further amended as follows:
by the addition to section 5(a) of the following:
"5(a) . . . The pensions referred to in this sub-section may be payable as from the date of death of the former participant".

CHAPTER IV.

1. This Statute shall be construed with and as part of Statutes 1 - 159 of University College, Cork and may be cited as Statute 160 of University College, Cork or Stat. 160 of Univ. Coll. Cork.
2. This Statute will come into operation on the tenth day of March, 1992.
