Statute CXXXVIII.
Irish Universities Act, 1908
University College, Cork
We, the Governing Body of University College, Cork, under
and by virtue of the powers in that behalf conferred on us by
the said Act, Do by this present instrument under the Seal
of University College, Cork, make the Statute contained in
the Schedule hereof for the general government of the said
College.
Given under the Common Seal of University College, Cork, this twenty-third day of April, 1985.

Statute CXXXVIII.
Schedule
Statutes I. to CXXXVII. of University College, Cork shall be read
and construed with the additions, modifications and amendments
hereinafter set forth.
CHAPTER I.
Pension Scheme
- Statute LXXIX., Chapter I., section 8(a), is hereby amended
by the addition of the following:
" Provided that in the case of a salary increase awarded under
the terms of a National Wage agreement or similar
agreement or in accordance with a general salary increase
applicable in the Public Service, the Governing Body shall
review the pensions payable so as to maintain the relativity
referred to with effect from the date of said salary
increase".
- The provisions of section 1 shall be deemed to have taken
effect as from 1 September, 1983.
CHAPTER II.
Supplementary Provisions to the Contributory Spouses and
Children's Pension Plan
- The Supplementary Provisions to the Contributory Spouses
and Children's Pension Plan set forth in this Chapter shall apply to
those participants who
- (a) are members of the Plan as on 31 May, 1985. and who opt
for the supplementary provisions to be applied to them
or
- (b) become members of the Plan after 31 May, 1985
or
- (c) those participants referred to in section 2.
- The contributory Spouses and Children's Pension Plan
together with the Supplementary Provisions set forth in this
Chapter shall also apply to
- (a) male participants as on 31 December, 1976, and
- (b) female participants as on 31 March, 1982.
who not being members of the Plan now opt in writing for the Plan
together with the Supplementary Provisions on or before a date to
be determined by the Governing Body.
- Any reference to 'widow' or 'widower' in the Plan shall be
deemed to include reference to a surviving spouse of a participant or
retired participant irrespective of the date of marriage.
- Any reference to 'child' or 'children' in the Plan shall be
deemed to include reference to any legitimate child, illegitimate
child, step-child or adopted child of a member.
Provided any such child is under sixteen years of age or, if
pursuing a full-time course of education, is under twenty-one
years of age.
- (a) The provisions as to refund of contributions contained in
Statute CVIII., Chapter IV., section 11(d), (e) and (f), shall not
apply to the participants to whom the Supplementary Provisions
apply.
- (b) Should a participant to whom the Supplementary
Provisions apply leave the service of the College without
entitlement to any pension or lump sum, deferred or otherwise, and
whose pensionable service cannot be transferred to another
employment, the whole of his contributions to the Plan will be
refunded to him.
CHAPTER III.
Department of Plant Science
The Department of Botany shall henceforth be known as the
Department of Plant Science and the following professorship and
lectureships shall be deemed to be in said department:
- Professorship of Botany
- Lectureship in Botany
- Lectureship in Botany No. 2.
CHAPTER IV.
Lectureship in Clinical Pharmacology
- Statute CXXXIV., Chapter II., is hereby amended by the
replacement of sections 2 and 6 by the following:

- (a) The said Lectureship shall be a full-time office within the
meaning of the statutes of the College and of the University. The
term 'full-time' in this case shall not be interpreted as precluding the
holder of the Lectureship from holding and receiving a stipend
wholly in respect of a full-time appointment of the kind specified in
section 6 of this Chapter.
- (b) He shall, however, be precluded from engaging in private
practice or consultations in any form or retaining any fees which
may be received by him in connection with his work.
Provided that, in the event of him opting to arrange, in agreement with the Governing Body and with the hospital
authority, to devote not more than two sessions, each of
three hours duration, per week to private practice or
consultation work, the foregoing provisions shall not apply
to the private practice or consultation work carried out
during these two sessions. The stipend of the said Lecture-
ship shall be the same as that provided in Statute CXXXII.
Chapter I., section 7(c).
- 6. The said Lectureship shall be tenable only by the holder in a
permanent capacity of an office as a Consultant Clinical Pharmacologist in a teaching hospital recognised by the College and by the
University in which the said Consultant has, as of right, the control
of an adequate teaching or professional unit of beds, both male and
female.
- This Statute shall be construed with and as part of Statutes I.
to CXXXVII. of University College, Cork and may be cited as
Statute CXXXVIII. of University College, Cork or Stat. CXXXVIII.
of Univ. Coll. Cork.
- This Statute shall come into operation on the twenty-third
day of April, 1985.
