The High Court's decision in Farah Constructions v Say-Dee was handed down this morning.

Gleeson CJ, Gummow, Callinan, Heydon and Crennan J upheld the appeal and, in so doing, poured considerable scorn on the decision of the NSW Court of Appeal and any argument that a claim in knowing receipt is based on restitutionary principles.
