Statute I.

Universities Act, 1997

University College Cork -- National University of Ireland, Cork

We, the Governing Body of University College Cork -- National University of Ireland, Cork ("the University") under and by virtue of the powers conferred on us by the above Act, do by this present instrument under the Seal of the University make the Statute contained in the Schedule hereof for the general government of the said University.

SCHEDULE

Statute I

The Statutes of University College Cork and Statutes A - H of University College Cork - National University of Ireland, Cork, shall be read and construed with the additions, modifications and amendments hereinafter set forth.

CHAPTER I
The Registrar

  1. The Registrar shall be the senior officer having responsibility to the President for academic affairs and shall also be designated as Vice-President for Academic Affairs.
  2. The holder of the Office of Registrar shall be appointed by, and shall be removable by, the Governing Body.
  3. The remuneration payable to the holder of the Office of Registrar shall be determined by the Governing Body in accordance with the provisions of the Universities Act, 1997 ("the Act")
  4. The Registrar shall be an ex-officio member of the Governing Body in accordance with the provisions of the Act.
  5. The Registrar shall:
    (a) act as secretary to the Academic Council of the University, issue under the direction of the President to each member of the Academic Council the summons for its meeting, and prepare and maintain a record of the transactions of the Academic Council;
    (b) be responsible for monitoring the implementation of the University's academic policy subject to the overall authority of the President;
    (c) carry out the instructions of the Governing Body and of the Academic Council, in such reasonable ways as the Governing Body and Academic Council shall respectively prescribe, for the conduct of the general academic business of the College;
    (d) carry on under the direction of the President the correspondence of the College so far as it relates to academic matters;
    (e) be responsible for the administration of student recruitment, admission and registration;
    (f) prepare, under the direction of the Academic Council, the programmes of all examinations and shall be responsible for the conduct of such examinations;
    (g) be responsible for the maintenance of discipline and the good conduct of students and for the establishment and implementation of appropriate disciplinary procedures in that regard;
    (h) keep the student and graduate Registers of the College in such a manner and subject to such directions as may be prescribed. He/she shall, when required by the President or the Governing Body, prepare official documents of the College and shall preserve copies of same;
    (i) preserve all books, records or documents committed to his/her care by the President or the Academic Council and all such muniments, records, writings and documents as may be entrusted to him/her;
    (j) not allow any books, records or documents committed to his/her care to be removed by any person without the written permission of the President or of the Governing Body, or to be read or inspected by any person other than the President, a member of the Governing Body, or of the Academic Council, without the written permission of the President, or of the Governing Body, or of the Academic Council;
    (k) observe due secrecy with respect to all his/her official functions;
    (l) have responsibility for the supervision and/or co-ordination of such administrative services as the Governing Body may from time to time determine.
  6. Statute 96, Chapter VIII, and Statute 121, Chapter IV, are hereby deleted.

CHAPTER II
Professorship - Office of Registrar

  1. There shall be established such number of full-time and part-time Professorships (untitled), as determined by the Governing Body and as required to comply with the provisions set out in this Chapter, in the Faculty(ies), department(s) and subject(s) which shall be assigned and titled as the Governing Body shall decide.
  2. The holder of a Professorship established by this Chapter shall be the holder of the Office of Registrar or the former holder of said Office subject to the provisions of this Chapter. For as long as a holder also holds the Office of Registrar, the said Professorship shall be a part-time office, shall not be a pensionable office and a stipend shall not be payable in its respect. The duties attaching to said Professorship shall include acting as Deputy President when required by the President to do so.
  3. On ceasing to hold the Office of Registrar, and not having attained the age of sixty-five years, a holder of the Professorship shall be entitled to continue in office as a full-time Professor until he/she shall have attained the age of sixty-five years, to receive the stipend attaching to a full-time Professorship and the service rendered as full-time Professor shall be pensionable, in accordance with the provisions set out in Chapter III of this Statute.

Provided that, in the case of a former appointee to the Office of Registrar who was deemed to be a "new entrant" to the public service in accordance with the provisions of the Public Service Superannuation (Miscellaneous Provisions) Act, 2004, a holder of the Professorship in a full-time capacity shall not be entitled to retire before attaining the age of sixty-five years and shall not be obliged to retire on the grounds of having attained the age of sixty-five years.

  1. Statute 121, Chapter IV, is hereby deleted.

CHAPTER III
Pension Scheme and Office of Registrar

  1. The Office of Registrar shall be a pensionable office to which the provisions of Statute 79, as amended, and of the Pension Scheme annexed thereto, as amended, shall apply, subject to the provisions of this Chapter.
  2. The Registrar shall, subject to good conduct and the due fulfillment of duties, hold office for an initial period of five years and may, subject to satisfactory performance, be continued in office for a further period of five years, or for the period or periods until the Registrar shall have attained the age of sixty-five years, whichever period shall first expire

Provided that, in the case of an appointee to the Office of Registrar who is deemed to be a "new entrant" to the public service in accordance with the provisions of the Public Service Superannuation (Miscellaneous Provisions) Act, 2004, a holder of the Office of Registrar, either during the initial or subsequent period of five years referred to in this section, shall not be entitled to retire before attaining the age of sixty-five years and shall not be obliged to retire on the grounds of having attained the age of sixty-five years.

  1. In the event of a Professorship referred to in Chapter II of this Statute becoming a full-time office in accordance with the provisions of said Chapter, the said full-time Professorship shall be a pensionable office to which the provisions of Statute 79, as amended, and of the Pension Scheme annexed thereto, as amended, shall apply

Provided that pensionable service shall be reckoned only in respect of the period for which the said Professorship was a full-time Professorship.

  1. A former Registrar holding said Professorship in a full-time capacity shall, subject to good conduct and due fulfillment of duties, hold office until he/she shall have attained the age of sixty-five years.

Provided that, in the event of the said Professor also being in receipt of a preserved pension in relation to the previous appointment as Registrar, the amount of said pension and the remuneration attaching to the Professorship shall not, in aggregate, exceed the amount of the stipend attaching to the Office of Registrar
and
Provided that, in the case of an appointee to the Office of Registrar who on ceasing to hold office either at the end of the initial or subsequent period of five years, as referred to in the foregoing section 3, the former Registrar shall be entitled to pension benefits, or to preserved pension benefits, in accordance with the provisions of Statute 79, as amended, and the Pension Scheme annexed thereto, as amended.

  1. Statute 79, Chapter I., section 7(a)(iv), is hereby deleted.

CHAPTER IV

  1. This Statute may be cited as Statute I of University College Cork - National University of Ireland, Cork or Stat. I. of U.C.C.
  2. This Statute shall come into operation on the 8th day of March 2005.
