Statute LVI.

Irish Universities Act, 1908

University College, Cork

We, the Governing Body of University College, Cork, under and by virtue of the powers in that behalf conferred on us by the said Act, Do by this present instrument under the Seal of University College, Cork, make the Statute contained in the Schedule hereof for the general government of the said College.

Given under the Common Seal of University College, Cork, this twenty-second day of December, 1954.

Statute LVI.

Schedule

Statutes I. to LV. of University College, Cork, shall be read and construed with the additions, modifications and amendments hereinafter set forth.

CHAPTER I.
Professorship of Irish History

  1. There shall be established in the College, in the event of its institution by the Senate of the National University of Ireland, a Professorship of Irish History.
  2. The said Professorship shall be a full-time office within the meaning of the Statutes of the College and of the University. The stipend of the Professorship shall be the same as those provided for in Statute LI., Chapter I., Section 3 (b). The provisions of Statute LI., Chapter I., Section 5, and Chapter II., Section I, as amended, shall also apply to the office.
  3. The said Professorship shall be in substitution for the existing Lectureship in History instituted by Statute XXXIII., Chapter I., which Lectureship shall be abolished if the present holder is appointed to the Professorship hereby established or ceases by resignation or otherwise to hold office. Chapter I. of Statute XXXIII., shall, on the Occurrence of either of such events, be revoked.
  4. The said Professorship shall be a pensionable office and Table A of the Additional Pension Scheme annexed to Statute XXXIX., Chapter II., as already amended, shall be hereby further amended by the addition of the said office thereto.
  5. Faculties : Statute XXVII., Chapter II., as already amended, shall be hereby further amended by the addition of the subject Irish History to the Faculty of Arts and to the Faculty of Celtic Studies.
  6. The said Professorship shall be tenable for the same term and on the same conditions and the holder thereof shall be subject to the same duties and obligations as if the said office had been included in Statutes I. to LV. of University College, Cork.

CHAPTER II.
Faculty of Dairy Science
Lectureship in Dairy Chemistry

  1. There shall be established in the College, in the event of its institution by the Senate of the National University of Ireland, a Lectureship in Dairy Chemistry.
  2. The said Lectureship shall be a full-time office within the meaning of the Statutes of the College and of the University. The stipend of the Lectureship shall be the same as those provided for in Statute LI., Chapter 1., Section 3 (c). The provisions of Statute LI., Chapter I., Section 5, and Chapter II., Section 1, as amended, shall also apply to the office.
  3. The duties of the Lecturer shall be to lecture and examine in Dairy Chemistry for all Degrees, Diplomas and Certificates of the College and of the University under the direction of the Professor of Dairy Chemistry, and to discharge such other duties in the Department of Dairy Chemistry as shall be assigned to him by the said Professor.
  4. The said Lectureship shall be a pensionable office, and Table A of Statute XXXIX., Chapter III., as already amended, is hereby further amended by the addition of the said office thereto.
  5. The said Lectureship shall be tenable for the same term and on the same conditions and the holder thereof shall be subject to the same duties arid obligations as if the said office had been included in Statutes I. to LV. of University College, Cork.

CHAPTER III.
Professorship of Music: Increased Stipend

The stipend fixed by Statute LI., Chapter I., Section 3 (c) for the full-time Professorship of Music established by Statute XLVI., Chapter III., shall be the same as the stipends of the full-time Professorships to which Statute LI., Chapter I., Section 3 (b) applies.

CHAPTER IV.
Pension Fund No. 2

Statute XXXIX., Chapter II., Section 6(b) and Clause 7(c) of the Additional Pension Scheme attached thereto are hereby amended by the addition of the words " and in the case of the President after attaining 70 years of age " after the words "65 years of age" in the last line thereof.

CHAPTER V.
Full-time Assistants
Pension Funds Nos. 4 and 5

  1. Notwithstanding the provisions of Statute I., Chapter XVIII., a person who has been appointed by the Governing Body as full-time Assistant for seven consecutive years shall thereafter be deemed to be permanent, and shall hold office subject to good conduct and to the due fulfilment of his duties until he shall have attained the age of 65 years.
  2. Notwithstanding the provisions of Statute XXXIX., Chapters IV. and V., such permanent full-time Assistants shall be entitled on retirement to a pension on the same basis and subject to the same conditions as those that apply in the case of holders of full-time statutory offices with the proviso that instead of receiving credit for added years the period of qualifying service referred to in Section 1 of this Chapter shall be taken into account when calculating years of pensionable service.
  3. On appointment to a full-time University Professorship or Lectureship in the College of a person who immediately preceding such appointment had continuous service as a full-time Assistant in the College for a period exceeding seven years, such person shall have added to his pensionable service the number of years by which his continuous service as a full-time Assistant in the College exceeds seven years.
  4. The provisions of Section 2 of this Chapter respecting entitlement to a pension on retirement shall also apply in the case of such full-time clerical officers and library assistants with at least ten years' full-time continuous service as the Governing Body may determine by resolution after completion of the said ten years' continuous full-time service.

CHAPTER VI.
Payment to Widows

  1. Statute XLVII., Chapter II., Section 1 (d) is hereby amended by the insertion in the fourth line of the Section between the words "per annum" and " and shall be" of the words " or be less than £100 per annum."
  2. The privilege of participation in the Scheme for Payment of Pensions to Widows of deceased holders of full- time statutory offices as already provided for shall be extended on the same basis to full-time married Assistants who qualify as permanent in accordance with Chapter V. of this Statute, and to such full-time married clerical officers and library assistants having at least ten years' continuous full-time service as the Governing Body may determine by resolution after completion of the said ten years' continuous full-time service.

CHAPTER VII.
Children's Allowances

The provisions of Statute LIII., Chapter I., shall also apply to the widows of full-time assistants who qualify as permanent in accordance with Chapter III. of this Statute, and to the widows of such full-time clerical officers and library assistants who have had at least ten years' continuous full-time service as the Governing Body may determine by resolution after completion of the said ten years' continuous full-time service.

CHAPTER VIII.
Non-Recurring Payments

Notwithstanding the provisions of Statute LI., Chapters I., II., and VI I., a temporary increase of five per cent. on the statutory salary paid to each full-time statutory office holder in respect of the year ended 30th June, 1954, is hereby authorised ; and a temporary increase at the rate of £5 per qualified child per annum in respect of the year ended 30th June, 1954, is hereby authorised to every full-time statutory office holder in receipt of Children's Allowances.

CHAPTER IX.

  1. Notwithstanding the provisions of Statute I., Chapter XX., Section 2, and all amendments thereof, the Registrar shall receive a stipend of £300 per annum, and shall, in addition, be entitled to either residence, fuel and light, or, at the discretion of the Governing Body, an allowance at the rate of £300 per annum in lieu thereof.
  2. Section 5 of Chapter XX. of Statute I. is hereby revoked.
  3. Section 12 of Chapter XXI. of Statute I. is hereby revoked and the following substituted therefor :

    He shall be responsible to the Governing Body for the general charge of the buildings and property of the College.

  4. The following shall be added to Statute I., Chapter XIX., Section 2.

    Provided that in the case of the Registrar, the Academic Council shall make a report on the candidates t o the Governing Body.

CHAPTER X.

  1. This Statute shall be construed with and as part of Statutes I. to LV. of University College, Cork, and may be cited as Statute LVI. of University College, Cork, or Stat. LVI. of Univ. Coll., Cork.
  2. This Statute shall come into operation on the seventeenth day of December, 1954.
