We, the Governing Body of University College, Cork, under and by virtue of the powers in that behalf conferred on us by the said Act, Do by this present instrument under the Seal of University College, Cork, make the Statute contained in the Schedule hereof for the general government of the said College.

Statutes I. to XXIII. of University College, Cork, shall be read and construed with the additions, modifications and amendments as hereunder set forth.
Pension Fund for Professors and Servants appointed before the Act of 1908.
(a) The sum of Ten Thousand Pounds having been set aside in different amounts at different dates in accordance with Section 2 of Chapter XXV. of Statute I., and the annual sum of £1,200 having been set apart since 1st October, 1917, and an Actuarial Report having been now obtained in accordance with Chapter I. of Statute XI., the said Chapter is hereby revoked. Section 2 of Chapter XVI. is also hereby revoked.
(b) Out of the income granted for the maintenance of the College under the provisions of the Act of 1908, and the University Education (Agriculture and Dairy Science) Act of 1926, or out of the moneys of the College applicable thereto, an annual sum of £1,020 shall be set apart as from 1st October, 1929, as a fund for the purpose of securing the pensions payable at present or in the future to the following persons, namely:-

Provided that the said annual sum of not less than £1,020, together with the sum referred to in Section (a), may be used as security for borrowing a capital sum should the necessity arise; but the sum so borrowed and its accretions, if any, shall be devoted exclusively to the payment of the pensions payable at present or in the future to the persons named above.
(c) All unexpended balances of the interest, dividends or other annual produce of the sums mentioned in this preceding Section, or of the moneys, so borrowed, shall be invested in such Securities as Trustees in Saorstát Éireann are authorised to invest in; and the sum the accumulated shall be subject to any charges for payment of the above pensions or benefits mentioned in the preceding Section, or any of them, should the annual sum of not less than £1,020 not suffice for that purpose; and in the event of the funds hereinbefore recited proving insufficient, the deficit shall be made good by other funds of the College.
At the end of a period of ten years from the date hereof, or should it appear that two-thirds of the liabilities due as above shall have lapsed, it shall be the duty of the Governing Body to obtain an Actuarial Report as to this Pension Fund, and to make a new Statute securing the solvency of the Fund.
If on the occasion of an Actuarial investigation it shall appear that the amount of this Pension Fund exceeds the amount estimated by the Actuary as being necessary to secure the solvency of the Fund; or, should the Governing Body decide to charge the remaining pensions against the annual income, such excess in whole or in part may, if the Governing Body so desire, be transferred and be applied to the general Purposes of the College,
Statute XVI. and the Scheme attached thereto and which instituted the Additional Pension Fund for the President, Professors, Lecturers and Officers appointed under the Act of 1908, shall be amended as follows:-
The sum of Eighteen Thousand Pounds having been set aside in different amounts at different dates.
Out of this income granted by the Oireachtas for the maintenance of the College under the provisions of the Act of 1908 and this University Education (Agriculture and Dairy Science) Act of 1926, or out of the moneys of the College applicable thereto, an annual sum of £2,400 shall be set apart as from the 1st October, 1929, as a fund for the purpose of securing the pensions, gratuities and the like payable to holders of Offices as per Table A of the Scheme attached to Statute XVI. and Table B of the Scheme attached to this Statute.
The moneys so set apart, together with the accruing dividends, interest and other annual produce thereof, shall be invested by the Governing Body in such securities as Trustees in Saorstát Éireann may be authorized to invest in The Fund so accumulated, together with the amount referred to in Section 1, shall be applied to no other purpose than that of the provision of annual pensions, gratuities and the like as determined by the Scheme of Pensions attached to this Statute as per Table A of the Scheme attached to Statute XVI. and Table B of the Scheme attached to this Statute.
In lieu of the provisions made in Statute XVI., the holders of Pensionable Offices mentioned in Table A of the said Statute and those mentioned in Table B in the attached Scheme shall, subject to the provisions of Clause (f) below in this Section, be entitled to:-
(a) An annual pension on retirement calculated at one-sixtieth of the salary or stipend of the Office as fixed by Statute XXI. for each full year of service, or at such reduced scale in accordance with Section 13 of Statute XVI. as the Governing Body may at the close of each quinquennial period determine.
Provided that the Pensioner may be allowed, at the absolute discretion and on a basis to be fixed by the Governing Body, to commute an amount not exceeding one-fourth of his Pension for a lump sum cash payment; and
Provided that any Pension granted by such Scheme shall not in annual value exceed two-thirds of the annual stipend of the office.
(b) On this occurence of the death of a pensionable Officer after ten years' service, before retirement the Governing Body shall pay a gratuity equal to one year's salary or stipend, but no more, to the immediate family or dependents (as may be determined by this Governing Body on their obsolete discretion).
(c) In the event of the death of an Officer while in Office, without leaving immediate family or dependents this Governing Body shall not grant any allowance whatever out of the Additional Pension Fund to his legal personal representatives.
(d) If the holder of a pensionable Office after not less than fifteen years' service shall retire voluntarily, the Governing Body shall have power at its absolute discretion to make to the retiring Officer a gratuity for good service not being in amount more than one-half the amount of one year's stipend of the retiring Officer.
(e) Any holder of a pensionable Office who has not attained the statuary age of retirement, but who by medical evidence satisfies the Governing Body that he is incapable, from infirmity of mind or body, of discharging the duties of his Office, and that such incapacity is likely to be permanent, shall receive such pension as shall be fixed by the Governing Body, but in no case greater than according to the scale hereinbefore mentioned if upon the report of an Actuary the Governing Body is satisfied that the Fund is able to bear such payment.
(f) An Actuarial Report as to the state of the Additional Pension Fund shall be obtained at the chose of every five years from 1st October, 1929 and if it shall appear to the Governing Body on consideration of such report that, for any reason, the Fund is insufficient to provide pensions at the scale referred to in Section (a) of this Chapter, the Governing Body shall have powers to reduce the scale upon which all pensions charged and to be charged upon the Additional Pension Fund shall be paid;
Provided always that before any reduction of benefits shall be determined upon, the Governing Body shall take into account the existence of any surplus in the General Funds of the College, and if satisfied that this surplus or any part of it is not required for the ordinary working of the College the Governing Body may from year to year apply such part of this surplus as it shall think fit in respect of the insufficiancy of the Pension Fund;
Provided also that if the pension scale contemplated in Section (a) be departed from as the result of any actuarial investigation, such scale may in respect of all the pensions charged or to be charged be restored to the normal scale or a scale more approximate to the normal at any subsequent actuarial investigation, such restoration nevertheless taking effect only as from the date of such actuarial investigation.
Pensions on retirement, whether on the ground of age, ill-health or other incapacity from infirmity of mind or body, shall be paid only after ten full years of service.
Any provisions in Statutes I., XI., and XVI. inconsistent with the foregoing provisions of the Pension Scheme hereinafter set out are hereby revoked.
On the occurence of a vacancy in any of the full-time Professorships or Lectureships of the College, as set forth in Statute XXI., the stipend of the vacant full-time Office on the subsequent filling of the vacancy shall be in the first year of the new appointment to the Office a sum of the amount of 75 per cent. of the stipend as set forth in Statute XXI., and shall increase in each subsequent year by 5 per cent. of such last-mentioned stipend, until the amount of the stipend stated in Statute XXI. shall have been reached;
Provided that such initial reduction shall not apply in the case of any appointment where the person so appointed shall have previously held in the College either a full-time Professorship or a full-time Lectureship; and
Provided that nothing in the terms of this Chapter shall abridge or imply a limitation on the Statutory power of the Governing Body of the College on the occurence of a vacancy in any Statutory Office to abolish such Office or to alter by Statute this terms on which such Office is held.
Out of the annual income granted by the Oireachtas for the endowment of the Faculty of Dairy Science under the provisions of the University Education (Agriculture and Dairy Science) Act, 1926, Section 13, the following amounts shall he set apart by the Governing Body to constitute a fund to be entitled " The Faculty of Dairy Science Pension Fund." viz.:-
(a) The Capital and Income at present standing to the credit of the Account known as " Pension Fund Account (No. 3)."
(b) An annual sum equivalent to ten per cent. of the amount of the annual Statutory Salaries of the Professorship and Lectureships as established by Statute XX., including a similar allowance in respect of the additional salary attached to the Professorship of Agriculture for the duties of Director of the Farm.
(c) An annual sum equivalent to ten per cent. of the annual salary of any other Office which may be established as a pensionable Office in the Faculty of Dairy Science from the date on which such Office may be established as a pensionable Office.
The pensions, gratuities and the like to be granted to the said Professor and Lecturers, shall be on the same basis as laid down in Chapter II. of this Statute and the Scheme attached thereto, and subject to the same conditions and regulations as are applicable thereto in Statute XVI. and this Statute, and made in connection therewith for Professors and Lecturers appointed after 1908.
The sums so set apart, together with the accruing dividends, interest and other annual produce thereof, shall be invested by the Governing Body in such Securities as trustees in Saorstát Éireann are or may be authorized to invest in. The Fund so accumulated shall be applied to no other purpose than that of the provision of annual pensions gratuities and the like, for the Offices established in the Faculty of Dairy Science.
Any expenses which may be incurred in this administration of the Faculty of Dairy Science Pension Fund shall be defrayed out of the annual income granted for the Dairy Science Faculty.
There shall be in the College, in the event of such Lectureship being instituted within the College by the Senate of the National University of Ireland, the following Lectureship:-
A Lectureship in Irish
The stipend of the said Lectureship shall be £550 per annum.
The said Lectureship shall be a pensionable Office in accordance with Statute XVI. and Chapter II. of this present Statute and the pension Scheme annexed.
This Lectureship is in lieu of the Assistantship in Irish heretofore existing in the College and the said Assistantship shall cease to exist on the appointment being made to the said Lectureship.
The said Lectureship shall be a full-time Lectureship within the meaning of the Statutes of the College and University.
The said Lectureship shall be tenable for the same term and upon the same conditions, and the holder thereof shall be subject to the same duties and obligations as if the said Lectureship had been included in Statutes I. to XXIII. of this College.
There shall be in the College, in the event of such Lectureships being instituted within the College by the Senate of the National University of Ireland, the following Lectureships:-
*A Lectureship in History and Geography at a salary of £500 per annum.;
*A Lectureship in Chemistry at a Salary of £450 per annum;
*A Lectureship in Mathematics at a salary of £450 per annum; and
A Lectureship in Education at a salary of £250 per annum.
* The Lectureships to the title of which an asterisk is prefixed shall be full-time Lectureships within the meaning of the Statutes of the College and University.
The said full-time Lectureships shall be pensionable Offices in accordance with Statute XVI. and Chapter II. of this present Statute and the Pension Scheme annexed.
The Lectureship in Chemistry is in lieu of the Assistantship in Chemistry through the medium of Irish, and the said Assistantship shall cease to exist on an appointment being made to the said Lectureship.
The holders of the above Lectureship shall primarily lecture through the medium of Irish.
The said Lectureships shall be tenable for the same term and upon the same conditions, and holders thereof shall be subject to the same duties and obligations as if the said lectureships had been included in Statutes I to XXIII of this College.
This Statute shall be construed with and as part of Statutes I. to XXIII. of University College, Cork, and may be cited as Statute XXIV. of University College, Cork, or Stat. XXIV. of Univ. Coll., Cork.
This Statute shall come into operation on the 23rd day of December One Thousand Nine Hundred and Twenty-nine.

The provisions of the Pension Scheme appended to Statute XVI are adopted with the following amendments, etc.:-

The pensionable Offices under this Scheme shall be only those specified in Table A annexed to the Scheme of Statute XVI., and the salaries of those Offices for the computation of pension or the award of a gratuity shall be those set forth in Statute XXI. and not the salaries set forth in Table A., Statute XVI., and the further Offices set forth in Table B. as under, and the further Lectureships which are pensionable created by this present Statute, at the annual salaries as set forth for the Offices in Statute XXI. and this Statute.

The provisions of Section 7 of Statute XVI. and the provisions of Section 7 of the Scheme attached thereto are hereby revoked, and the provisions for pension, gratuity and the like shall be as set forth in Section 4, Chapter II. of the Schedule of this Statute (Statute XXIV.), viz.:-
