Statute XXIV.

Irish Universities Act, 1908

University College, Cork

We, the Governing Body of University College, Cork, under and by virtue of the powers in that behalf conferred on us by the said Act, Do by this present instrument under the Seal of University College, Cork, make the Statute contained in the Schedule hereof for the general government of the said College.

Statute XXIII.

Schedule

  1. Statutes I. to XXIII. of University College, Cork, shall be read and construed with the additions, modifications and amendments as hereunder set forth.

CHAPTER I.

  1. Pension Fund for Professors and Servants appointed before the Act of 1908.

CHAPTER II.

Statute XVI. and the Scheme attached thereto and which instituted the Additional Pension Fund for the President, Professors, Lecturers and Officers appointed under the Act of 1908, shall be amended as follows:-

  1. The sum of Eighteen Thousand Pounds having been set aside in different amounts at different dates.

  2. Out of this income granted by the Oireachtas for the maintenance of the College under the provisions of the Act of 1908 and this University Education (Agriculture and Dairy Science) Act of 1926, or out of the moneys of the College applicable thereto, an annual sum of £2,400 shall be set apart as from the 1st October, 1929, as a fund for the purpose of securing the pensions, gratuities and the like payable to holders of Offices as per Table A of the Scheme attached to Statute XVI. and Table B of the Scheme attached to this Statute.

  3. The moneys so set apart, together with the accruing dividends, interest and other annual produce thereof, shall be invested by the Governing Body in such securities as Trustees in Saorstát Éireann may be authorized to invest in The Fund so accumulated, together with the amount referred to in Section 1, shall be applied to no other purpose than that of the provision of annual pensions, gratuities and the like as determined by the Scheme of Pensions attached to this Statute as per Table A of the Scheme attached to Statute XVI. and Table B of the Scheme attached to this Statute.

  4. In lieu of the provisions made in Statute XVI., the holders of Pensionable Offices mentioned in Table A of the said Statute and those mentioned in Table B in the attached Scheme shall, subject to the provisions of Clause (f) below in this Section, be entitled to:-

  5. Pensions on retirement, whether on the ground of age, ill-health or other incapacity from infirmity of mind or body, shall be paid only after ten full years of service.

  6. Any provisions in Statutes I., XI., and XVI. inconsistent with the foregoing provisions of the Pension Scheme hereinafter set out are hereby revoked.

CHAPTER III.

On the occurence of a vacancy in any of the full-time Professorships or Lectureships of the College, as set forth in Statute XXI., the stipend of the vacant full-time Office on the subsequent filling of the vacancy shall be in the first year of the new appointment to the Office a sum of the amount of 75 per cent. of the stipend as set forth in Statute XXI., and shall increase in each subsequent year by 5 per cent. of such last-mentioned stipend, until the amount of the stipend stated in Statute XXI. shall have been reached;

Provided that such initial reduction shall not apply in the case of any appointment where the person so appointed shall have previously held in the College either a full-time Professorship or a full-time Lectureship; and

Provided that nothing in the terms of this Chapter shall abridge or imply a limitation on the Statutory power of the Governing Body of the College on the occurence of a vacancy in any Statutory Office to abolish such Office or to alter by Statute this terms on which such Office is held.

CHAPTER IV.

  1. Out of the annual income granted by the Oireachtas for the endowment of the Faculty of Dairy Science under the provisions of the University Education (Agriculture and Dairy Science) Act, 1926, Section 13, the following amounts shall he set apart by the Governing Body to constitute a fund to be entitled " The Faculty of Dairy Science Pension Fund." viz.:-

  2. The pensions, gratuities and the like to be granted to the said Professor and Lecturers, shall be on the same basis as laid down in Chapter II. of this Statute and the Scheme attached thereto, and subject to the same conditions and regulations as are applicable thereto in Statute XVI. and this Statute, and made in connection therewith for Professors and Lecturers appointed after 1908.

  3. The sums so set apart, together with the accruing dividends, interest and other annual produce thereof, shall be invested by the Governing Body in such Securities as trustees in Saorstát Éireann are or may be authorized to invest in. The Fund so accumulated shall be applied to no other purpose than that of the provision of annual pensions gratuities and the like, for the Offices established in the Faculty of Dairy Science.

  4. Any expenses which may be incurred in this administration of the Faculty of Dairy Science Pension Fund shall be defrayed out of the annual income granted for the Dairy Science Faculty.

CHAPTER V.

  1. There shall be in the College, in the event of such Lectureship being instituted within the College by the Senate of the National University of Ireland, the following Lectureship:-

    A Lectureship in Irish

  2. The stipend of the said Lectureship shall be £550 per annum.

  3. The said Lectureship shall be a pensionable Office in accordance with Statute XVI. and Chapter II. of this present Statute and the pension Scheme annexed.

  4. This Lectureship is in lieu of the Assistantship in Irish heretofore existing in the College and the said Assistantship shall cease to exist on the appointment being made to the said Lectureship.

  5. The said Lectureship shall be a full-time Lectureship within the meaning of the Statutes of the College and University.

  6. The said Lectureship shall be tenable for the same term and upon the same conditions, and the holder thereof shall be subject to the same duties and obligations as if the said Lectureship had been included in Statutes I. to XXIII. of this College.

CHAPTER VI.

  1. There shall be in the College, in the event of such Lectureships being instituted within the College by the Senate of the National University of Ireland, the following Lectureships:-

    *A Lectureship in History and Geography at a salary of £500 per annum.;

    *A Lectureship in Chemistry at a Salary of £450 per annum;

    *A Lectureship in Mathematics at a salary of £450 per annum; and

    A Lectureship in Education at a salary of £250 per annum.

    * The Lectureships to the title of which an asterisk is prefixed shall be full-time Lectureships within the meaning of the Statutes of the College and University.

  2. The said full-time Lectureships shall be pensionable Offices in accordance with Statute XVI. and Chapter II. of this present Statute and the Pension Scheme annexed.

  3. The Lectureship in Chemistry is in lieu of the Assistantship in Chemistry through the medium of Irish, and the said Assistantship shall cease to exist on an appointment being made to the said Lectureship.

  4. The holders of the above Lectureship shall primarily lecture through the medium of Irish.

  5. The said Lectureships shall be tenable for the same term and upon the same conditions, and holders thereof shall be subject to the same duties and obligations as if the said lectureships had been included in Statutes I to XXIII of this College.

This Statute shall be construed with and as part of Statutes I. to XXIII. of University College, Cork, and may be cited as Statute XXIV. of University College, Cork, or Stat. XXIV. of Univ. Coll., Cork.

This Statute shall come into operation on the 23rd day of December One Thousand Nine Hundred and Twenty-nine.

PENSION SCHEME

The provisions of the Pension Scheme appended to Statute XVI are adopted with the following amendments, etc.:-

  1. Section 2 shall read-

    The pensionable Offices under this Scheme shall be only those specified in Table A annexed to the Scheme of Statute XVI., and the salaries of those Offices for the computation of pension or the award of a gratuity shall be those set forth in Statute XXI. and not the salaries set forth in Table A., Statute XVI., and the further Offices set forth in Table B. as under, and the further Lectureships which are pensionable created by this present Statute, at the annual salaries as set forth for the Offices in Statute XXI. and this Statute.

  2. The provisions of Section 7 of Statute XVI. and the provisions of Section 7 of the Scheme attached thereto are hereby revoked, and the provisions for pension, gratuity and the like shall be as set forth in Section 4, Chapter II. of the Schedule of this Statute (Statute XXIV.), viz.:-

  3. Pensions on retirement, whether on the ground of age, ill-health or other incapacity from infirmity of mind or body, shall be paid only after ten full years of service.

  4. Section 8 of the Pension Scheme of Statute XVI. is hereby revoked, and in place thereof it is hereby provided that in the case of the transference during the period of his service in the College of an Officer from one pensionable Office to another pensionable Office, his pension shall be computed as for the whole period of his pensionable service on the salary of the Office which he holds at the date of his retirement.
