University College, Cork

WE, THE GOVERNING BODY OF UNIVERSITY COLLEGE CORK, under and by virtue of the powers in that behalf conferred on us by the above Act, do by this present instrument under the seal of University College, Cork make the Statute contained in the Schedule hereof for the general government of the said College.

Given under the Common Seal of University College, Cork this Nineteenth day of December, 1995.

Statute 171

Schedule

Statutes 1 to 170 of University College, Cork shall be read and construed with the additions, modifications and amendments hereinafter set forth.

CHAPTER I.
Stipends

  1. Nothwithstanding any provisions to the contrary contained in Statutes 1 to 170 of University College, Cork, the annual stipends of the President, of the Professorships, Associate Professorships and Lectureships referred to in this Chapter, and of the Officers of the College shall, as from the dates specified, be as hereinafter set forth.

  2. The annual stipend of the Vice-Presidents shall, as from the dates indicated, be as follows:

  3. The annual stipend of the Registrar and of the Finance Officer and Secretary shall, as from the dates indicated, be as follows:

  4. The annual stipend of the Librarian and of the Planning Officer shall be the same as that provided in section 3(a) hereof.

  6. The annual stipend of the part-time Lectureship in Public Administration shall be such an amount as is determined by the Governing Body, having determined the quantum of duties to be attached to the Lectureship, provided that the said stipend shall not exceed 65% of the maximum stipend of a full-time lectureship as set forth in Chapter I., section 5(a), of this Statute.

  7. The provisions set out in previous statutes whereby the duties attaching to the holder of offices in clinical medical and dental subjects include the obligation to discharge such professional duties appropriate to the office shall be deemed to be subject to the provisions of a contract, the terms of which are approved by the Governing Body and signed by the holder of each of the said Offices.

  8. Such of the foregoing stipends as relate to full-time appointments are based on the concept of total remuneration as set out in Report No. 2 (30 October, 1979) of the Review Body on Higher Remuneration in the Public Sector (Prl. 8128) and as applied by resolution of the Governing Body.

  9. The provisions of Statute 58, Chapter I., section 5, shall not apply in the case of appointments made on or after 1 February, 1996.

CHAPTER II
Pension Scheme

  1. Statute 79, Chapter I., section 7(a) IX., is hereby amended by the substitution of the words "All other full-time permanent staff ... " for the words "Full-time clerks, library assistants and servants . . "

  2. Clause 17(c) of the Pension Scheme annexed to Statute 79, as amended, is hereby deleted and replaced by the following: "17(c) The aggregate of added years allowed under the provisions of this Clause and of added years which may be allowed under the provisions of Statute 79, section 8, as amended, shall not exceed ten" .

  3. The foregoing provisions shall be deemed to come into effect as from 30 September, 1994.

CHAPTER III
Professorship of Surgery

  1. The provisions of this Chapter shall henceforth apply to the Professorship of Surgery, established by Statute 73, Chapter VIII.

  2. Commencing with the next appointment to the Professorship of Surgery the said Professor shall be Head of the Department of Surgery for a period of at least five years. In the event of the Governing Body determining, by the making of a Statute or Regulation or otherwise, that new arrangements shall apply to the appointment of the Head of the Department of Surgery the holder of said Professorship shall thenceforth have the obligation of acting as Head of the Department of Surgery for such period or periods as the Governing Body may decide.

  3. The duties of the Professor shall be to lecture in Surgery for all degrees, diplomas and certificates of the University and for all diplomas and certificates of the College. In the event of a revised arrangement in regard to the appointment of a Head of Department referred to in section 2 applying, the Professor shall carry out the lecturing duties under the general direction of the Head of the Department of Surgery. The Professor shall also examine in Surgery for the College and, if required by the Senate to do so, for the University.

  4. The stipend of the next holder of the Professorship of Surgery shall be the same as that provided in Chapter I., section 3(d), of this Statute.

CHAPTER IV.
Professorship of Medical Microbiology

  1. The provisions of this Chapter shall henceforth apply to the Professorship of Medical Microbiology, established by Statute 123, Chapter I.

  2. The said Professorship shall, subject to the provisions of section 3(b) hereof, be in the Department of Pathology and shall be a full-time office within the meaning of the Statutes of the College and of the University. The stipend of the said Professorship shall be such amount, as determined by the Governing Body, not exceeding 25% of the maximum stipend attaching to a non-clinical professorship as provided in Statute 132, Chapter I., section 4(a), as amended, together with such other sum as shall be agreed between the Governing Body and the hospital authority for which the duties of the office of Consultant, referred to in section 5, are carried out; the total stipend attaching to the Professorship shall be computed to reflect the workload referred to in section 4.

  3. The duties of the Professor shall be:

  4. The said Professorship shall be tenable only by the holder in a permanent capacity of an office of Consultant/Medical Microbiologist, with duties in a hospital which is recognized by the College and the University as a teaching hospital.

  5. The said Professorship shall be a pensionable office to which the provisions of Statute 79, as amended, and the Pension Scheme annexed thereto, as amended, shall apply .

CHAPTER V
The Librarian

  1. Statute 26, Chapter II., is hereby amended by the addition thereto of the following: "6. The Librarian shall carry out under the direction of the President duties in regard to administrative matters appropriate to the Office and other duties appropriate to the Office as may be assigned to him/her by the Governing Body"
  2. The foregoing provision shall be deemed to come into effect as from 1 July, 1995.

CHAPTER VI.
Lectureship in Nursing Studies

  1. There shall be established in the College, in the event of its institution by the National University of Ireland, a Lectureship in Nursing Studies.
  2. The said Lectureship shall be in the Department of Nursing Studies and shall be a full-time office within the meaning of the Statutes of the College and of the University. The stipend of the said Lectureship shall be the same as that provided in Chapter I., section 5(a) of this Statute.
  3. The duties of the Lecturer shall be to lecture in Nursing Studies for all degrees, diplomas and certificates of the University and for all diplomas and certificates of the College. In the event of the establishment of a Professorship of Nursing Studies and the holder thereof being appointed as Head of the Department of Nursing Studies, the Lecturer shall carry out the foregoing duties under the direction of said Head of Department. The Lecturer shall also examine in Nursing Studies for the College and, if required by the Senate to do so, for the University. He/She shall, in addition, discharge such other duties appropriate to the office as shall be assigned to him/her by the Head of the Department of Nursing Studies.
  4. The holder of the said Lectureship shall, if so appointed by the Governing Body, act as Head of the Department of Nursing Studies for such period or periods as the Governing Body may decide or until the appointment shall have been terminated by the Governing Body.
  5. The said Lectureship shall be a pensionable office to which the provisions of Statute 79, as amended and the Pension Scheme annexed thereto, as amended, shall apply.
  6. The Lectureship hereby established shall, subject to the provisions contained in this Chapter, be tenable for the same term and upon the same conditions and the holder thereof shall be subject to the same duties and obligations as if the said Lectureship had been included in Statute 1 to 170 of University College, Cork.

CHAPTER VII.
Department of Microbiology

The Department of Food Microbiology shall henceforth be known as the Department of Microbiology.

CHAPTER VIII.
Headship of Department

  1. An Associate Professor shall accept an appointment as Head of Department, if so appointed by the Governing Body, for such period or periods as the Governing Body may decide, or until the appointment shall have been terminated by the Governing Body.
  2. An Associate Professor shall accept an appointment as Acting Head of Department, if so appointed by the President, for such period or periods as the President may decide, or until the appointment shall have been terminated by the President.
  3. The foregoing provisions shall apply to the holders of Associate Professorships, appointed thereto on or after 1 February, 1996.

CHAPTER IX.

  1. This Statute shall be construed with and as part of Statutes 1 to 170 of University College, Cork and may be cited as Statute 171 of University College, Cork or Stat. 171 of Univ. Coll. Cork.
  2. This Statute will come into operation on the Nineteenth day of December, 1995.
