University College, Cork

We, the Governing Body of University College, Cork, under and by virtue of the powers in that behalf conferred on us by the said Act, Do by this present instrument under the Seal of University College, Cork, make the Statute contained in the Schedule hereof for the general government of the said College.

Given under the Common Seal of University College, Cork, this sixteenth day of February, 1988.

Statute CXLV. (145)

Schedule

Statutes I. to CXLIV. of University College, Cork shall be read and construed with the additions, modifications and amendments hereinafter set forth.

CHAPTER I.

1. Statute LXXIX., Chapter I., section 2, as already amended, is hereby further amended by the addition thereto of the following further proviso:

   "Provided that, in the case of a participant who is in receipt of remuneration, the level of which has been determined by the Governing Body by reference to a salary or wage rate which is subject to a pension contribution payable by the recipient, said contribution shall also be payable by the participant".

2. Clause 1 of the Pension Scheme annexed to Statute LXXIX. shall hereby be further amended by the addition thereto of the following:
   • "(e) Notwithstanding the foregoing provisions of this section, the Scheme shall not apply to those employed by the College in respect of whom alternative pension arrangements have been made as determined by the Governing Body".
   • "(f) The Pension Scheme, subject to the provisions of Clause 13 (e) hereof, shall also apply to those employed by the College under the terms of a job-sharing scheme, the provisions of which being determined by the Governing Body from time to time, whereby the duties of a full-time post are shared equally by two persons".
3. Clause 13 of the Pension Scheme annexed to Statute LXXIX., as already amended, is hereby further amended by the addition thereto of the following:
   • "(e) Notwithstanding the foregoing provisions of this section, service rendered to the College under the terms of a job-sharing scheme, the provisions of which being determined by the Governing Body from time to time, whereby the duties of a full-time post are shared equally by two persons, shall also be deemed to be pensionable service but only to the extent of one-half of such service".
4. Statute CVIII., Chapter V., section 5 (a) is hereby amended by the addition thereto of the following:
   • (a) the addition to section 5 (a) of the following:

     "in the case of a further participant who was a member of the Spouses and Childrens' Pension Plan, a deferred pension and death gratuity may also be payable in the case of a widow or widower and children of said participant to whom the provisions of this chapter have been applied".

   • (b) the addition of the words "or widower of a former participant" after the word "widow" in section 5 (c).
   • (c) by altering the reference in section 5 (d) to "Widows and Childrens' Contributory Pension Plan" to "Spouses and Childrens' Contributory Pension Plan".
5. Statute CXXXVIII., Chapter I., section 1, is hereby amended by the substitution of the words "Clause 8 (a) of the Pension Scheme annexed to Statute LXXIX". for the words "Statute LXXIX., Chapter I., section 8(a)".
6. All references in these statutes to "General Pension Fund" and "Dairy Science Pension Fund" shall with effect from 1 October, 1987, be deemed to be references to the "University College, Cork Pension Fund".

CHAPTER II
Faculties

There shall be the following Faculties in the College:

Faculty of Arts,

Faculty of Celtic Studies,

Faculty of Commerce,

Faculty of Engineering,

Faculty of Food Science & Technology,

Faculty of Law,

Faculty of Medicine,

Faculty of Science.

CHAPTER III.

1. This Statute shall be construed with and as part of Statute I., to CXLIV. of University College, Cork and may be cited as Statute CXLV. of University College, Cork or Stat. CXLV. of Univ. Coll. Cork.
2. This Statute shall come into operation on the sixteenth day of February, 1987
