Statute CXLI.
Irish Universities Act, 1908
University College, Cork
We, the Governing Body of University College, Cork, under
and by virtue of the powers in that behalf conferred on us by
the said Act, Do by this present instrument under the Seal
of University College, Cork, make the Statute contained in
the Schedule hereof for the general government of the said
College.
Given under the Common Seal of University College, Cork, this eighteenth day of July, 1986.

Statute 141
Schedule
Statutes I. to CXL. of University College, Cork shall be read and
construed with the additions, modifications and amendments
hereinafter set forth.
- Section 1 of Chapter IV. of Statute I. shall henceforth be
entitled "section 1(a)" and there shall be added the following section
1(b):
"1(b) The President shall be chief academic and administrative
officer of the College and shall have general responsibility
to the Governing Body for maintaining and promoting the
efficiency and good order of the College".
- Statute I., Chapter IV., section 4, is hereby deleted.
- Statute I., Chapter IV., section 7, is hereby amended by the
insertion of the words "to the Governing Body" after the words
"Annual Report", and by the insertion of the words "for consideration at an ordinary meeting" after the words "Governing Body".
- Statute I., Chapter IV., section 18, is hereby amended by the
substitution of the words "his term of office expires" for the words
"he attains the age of seventy years".
CHAPTER II.
Pension Scheme
The provisions of Statute LXXIX., Chapter i., section 7(a)i. are
hereby deleted and replaced by the following:
"7(a)i. The President shall hold office for a period of ten years or
for the period until he shall have attained the age of sixty-five
years, whichever period shall first expire".
CHAPTER III.
Office of Vice-President
Statute CX., Chapter I., is hereby further amended by the addition
thereto of the following:
"6. The Vice-President shall, when required, attend meetings of
the Governing Body".
CHAPTER IV.
Professorship of General Practice
- There shall be established in the College, in the event of its
institution by the National University of Ireland, a Professorship of
General Practice.
- The said Professorship shall be a full-time office within the
meaning of the statutes of the College and of the University.
- The stipend of the Professorship shall be the same as that
provided in Statute CXXXII., Chapter I., section 4(a), as amended;
said stipend may be enhanced or reduced by resolution of the
Governing Body. following determination of the arrangement
referred to in section 5 hereof.
- The duties of the Professor shall be to lecture in General
Practice for all degrees, diplomas and certificates of the University
and for all diplomas and certificates of the College. He shall also
examine in General Practice for the College and, if required by the
Senate to do so, for the University.
- The duties shall, in addition, include the obligation to discharge such professional duties appropriate to the office in accordance
with an arrangement determined by the Governing Body.
- The Professor shall be precluded from engaging in private
practice or consultancies in any form or retaining any fees which may
be received by him in connection with his work except in so far as may
be provided under the arrangement referred to in section 5 hereof.
- The said Professorship shall be a pensionable office to which
the provisions of Statute LXXIX., as amended, and the Pension
Scheme annexed thereto, as amended, shall apply.
- The said Professorship shall, subject to the provisions of this
Chapter, be tenable for the same term and upon the same conditions
and the holder thereof shall be subject to the same duties and obligations as if the said Professorship had been included in Statutes I., to
CXL. of University College, Cork.
CHAPTER V.
Lectureship in Medicine No. 2
The Lectureship in Medicine No. 3, established by Statute XCVI.,
Chapter XII., shall henceforth be known as the Lectureship in
Medicine No. 2.
CHAPTER VI.
Lectureship in Medicine No. 3
- There shall be established in the College. in the event of its
institution by the National University of Ireland, a Lectureship in
Medicine No. 3.
- The said lectureship shall be a part-time non-pensionable
office. The stipend of the lectureship shall be IR£3,000 per annum.
- The duties of the lecturer shall be to lecture in Medicine
under the direction of the Professor of Medicine for all degrees,
diplomas and certificates of the University and for all diplomas and
certificates of the College. He shall also examine in Medicine for the
College and, if required by the Senate to do so, for the University.
He shall, in addition, discharge such other duties appropriate to the
office as shall be assigned to him by the said Professor of Medicine.
- The said lectureship shall be tenable only by a member of the
medical staff of the teaching hospital recognised by the College and
the University in which the Professor of Medicine has, as of right,
the control of the adequate teaching or professional unit of beds,
both male and female, and is the medical practitioner in charge.
- The said lectureship shall be in substitution for an existing
part-time assistantship in the Department of Medicine and the pro-
visions of Statute XXXIV., Chapter I., section 4 shall not apply.
- The said lectureship shall, subject to the foregoing provisions
of this Chapter, be tenable for the same term and upon the same
conditions and the holder thereof shall be subject to the same duties
and obligations as if the said lectureship had been included in
Statutes I., to CXL. of University College, Cork.
CHAPTER VII.
Pension Scheme
- Statute LXIX., Chapter I., section 8, as already amended,
is hereby further amended, subject to the provisions of section 2 of
this Chapter, by the replacement of the entire section by the
following:
- "8
- (a) For the purpose of computing the pension of a participant, the Governing Body shall have power to add to the
number of actual years (including the fraction of a year) of
pensionable service such number of years (including the
fraction of a year) as the Governing Body in its absolute
discretion may think fit."
Provided that the foregoing provision shall be exercised by the
Governing Body only in the case of a participant who is a
President, Officer, Professor, Lecturer or Assistant or holds
a post deemed by the Governing Body to be of a professional.
technical or specialist nature and in respect of whose appointment the qualifications and/or experience ordinarily required
would not permit an appointment of a person less than twenty-five years of age.
- (b) The total number of years added in accordance with the
provisions of sub-section (a) of this section shall not exceed
- i. the aggregate of the minimum number of years in
which the required qualification could be obtained and the
minimum number of years essential experience required,
such aggregate to be calculated as if the commencement
date was the participant's eighteenth birthday; or
- ii. the minimum age for the competition (if applicable) of
which the participant was recruited reduced by twenty-five
and when aggregated with other pensionable service, shall
not exceed forty years.
- (c) The number of years calculated in accordance with sub-section (b) shall be appropriately reduced where
- i. pensionable service has been or could have been transferred from any previous employment;
- ii. a participant has received or retains an entitlement to
a pension, preserved pension or other superannuation
benefit from any previous employment.
- iii. a participant has a pension entitlement under the Social
Welfare Acts, arising on contributions paid in previous
employment.
- A participant at the date hereof to whom the provisions of
Statute LXXIX., Chapter I., section 8 (prior to its amendment by
section 1 of this Chapter) may opt to have said provisions continue
to apply in his case as an alternative but not in addition to the provisions referred to in section 1 of the Chapter.
- The foregoing provisions shall be deemed to have come into
effect as from 1 January, 1983.
- This Statute shall be construed with and as part of Statutes I.,
to CXL. of University College, Cork and maybe cited as Statute CXLI.
of University College, Cork or Stat. CXLI. of Univ. Coll. Cork.
- This Statute shall come into operation on the eighth day of
July, 1986.
