Statute XCVI.
Irish Universities Act, 1908
University College, Cork
We, the Governing Body of University College, Cork, under and by
virtue of the powers in that behalf conferred on us by the said Act, Do by this
present instrument under the Seal of University College, Cork, make the Statute
contained in the Schedule hereof for the general government of the said College.
Given under the Common Seal of University College, Cork, this
twenty-ninth day of November, 1973.

Statute XCVI.
Schedule
Statutes I. to XCV. of University College, Cork shall be read and construed
with the additions, modifications and amendments hereinafter set forth.
CHAPTER I.
Increased Stipends
- Notwithstanding any provisions to the contrary contained in
Statutes I. to XCV. of University College, Cork, the annual stipends of the
President, of the professorships and lectureships set forth in this chapter and
of the Officers of the College shall, as from the dates specified hereunder, be
those hereinafter set forth.
- In the case of stipends set forth in this Chapter which are effective
from 1 June, 1973, the amounts specified shall be subject to a deduction of
forty-three pence in respect of the month of June, 1973 except where otherwise
specified.
- The annual stipends of the President, of the full-time professorships
and full-time lectureships and of the Officers of the College, with the
exception of the offices, full-time professorships and full-time lectureships
referred to in sections 5, 6(e), 6(g), 6(h) and 8(d) of this Chapter, shall be
increased by £52 per annum in respect of the period commencing on 1 June, 1966,
and terminating on 31 May, 1968.
- The annual stipend, pensionable value of residence, fuel and light and
expense allowance of the President shall as from the dates specified be as

- ii. The provision of section 2 of this Chapter shall apply to the
stipends of the full-time lectureships set in this sub-section.
- (e) The annual stipend of the Lectureship in Computer Science shall, in
respect of the period commencing on 1 June, 19 and terminating on the date of
coming into operation of Statute LXXXVII., be the same as that provided in
sub-section (a) hereof.
- (a) The annual stipend of the Secretary and Bursar shall be
same as that provided in section 6.(a) hereof.
- (b) The annual stipend of the Librarian shall be the same as that
provided in section 8.(a) hereof; from the date of coming into operation of
Statute XCI., the annual stipend of the Librarian shall be the same as that
provided in section 6.(a) hereof.
- (c) The annual stipend of the Director of the Computer Bureau (the
holder of which also holds the Lectureship in Computer Science) shall as from
the date of coming into operation of Statute LXXXVII., be the same as that
provided in section 6.(a) hereof.

CHAPTER II.
Children's Allowances
Statute LXVII., Chapter IV., section 2, as already amended, is hereby
further amended to the extent that the amount of the children's allowances
shall, as from 1 June, 1973, be £87 per annum in respect of each qualified
child.
CHAPTER III.
Increased Pensions
- The Governing Body has, in accordance with the provision of Clause
8 of the Pension Scheme annexed to Statute LXXIX., reviewed the pensions payable
to retired participants in the Scheme and to the widows of former participants
or retired participants. In consequence thereof the revised annual pensions set
out in sections 2, 3 and 4 shall be payable from the dates indicated.
- The pension payable to Mrs. Máire Mulcahy as set out in Statute
XCIV., Chapter III., section 1, shall be amended by the substitution of the
figure £264 for the figure £87 payable from 1 January, 1973, where it appears in
that section.
- The pensions payable to the following, as set out in Statute XCIV.,
Chapter III., section 1, shall be amended by the substitution of the amounts set
out below payable from the dates indicated:

- The pensions set out in the foregoing section in respect of those who
retired subsequent to the enactment of Statute LXXIX. are subject to the
provisions of Clause 14 (as amended) of the Pension Scheme annexed to that
Statute.
- Any increases in pension granted by this Statute will be deemed to be
part of any increases that may become payable under the terms of Clause 8 of the
Pension Scheme as amended by Statute LXXXV., Chapter I., upon the validation of
the latter Statute.
CHAPTER IV.
Pension Scheme
- The provisions of Statute LXXIX., Chapter I., section 7(a),
sub-paragraph x. shall not apply in cases where the marriage took place on or
after 1 June, 1972.
- The provisions of Statute LXXIX., Chapter I., section 11, shall not
apply to any full-time Lady Superintendent or to any full-time woman Assistant,
full-time woman Clerk or full-time woman Library Assistant, who enters the
full-time service of the College on or after 1 October, 1973.

- (a) Statute LXXIX., Chapter I., sections 8.(a) and 9, are hereby
amended by the deletion of the words "(if a full-time professor or lecturer)"
where they occur after the word "Registrar ".
- (b) Clause I of the Pension Scheme annexed to Statute LXXIX is hereby
amended by the deletion of the words "(provided that he is a full-time professor
or full-time lecturer of the College)" where they occur after the word
"Registrar".
- (c) The pensionable service of the Registrar shall be based on the
number of years he has held a pensionable post in the College and Statute
LXXIX., Chapter I., section 8.(a), is amended accordingly.
CHAPTER V.
Professorship of Mathematical Statistics
- Notwithstanding any provisions to the contrary contained in
Statute XXXIV., Chapter I., as amended, and with the consent of the present
holder of the Professorship of Statistics, established by Statute L., Chapter
I., the provisions of the said Statute L., Chapter I., as amended, shall be
replaced by the provisions contained in this Chapter.
- The said Professorship of Statistics shall henceforth be known as the "Professorship of Mathematical Statistics".
- The said Professorship of Mathematical Statistics shall as from the
coming into operation of this Statute cease to be a full-time professorship and
shall be a part-time professorship.
- The duties of the part-time professorship shall be to lecture in
Mathematical Statistics in the Department of Statistics for all degrees,
diplomas and certificates of the university and for all diplomas and
certificates of the College. He shall also examine in Mathematical Statistics
for the College and, if required to do so, for the University.

- (a) The said part-time professorship shall be a pensionable
office to which the provisions of Statute LXXIX., as amended and the Pension
Scheme annexed thereto, as amended, shall apply, subject to sub-section (b) of
this section.
- (b) Notwithstanding the provisions of Clause 13 of the Pension Scheme
annexed to Statute LXXIX., the service rendered by the holder of the part-time
professorship shall be deemed to be pensionable service.
- The stipend of the part-time Professorship of Mathematical Statistics
shall be £1,230 per annum.
- The said professorship shall be tenable for the same term and upon the
same conditions and the holder thereof shall be subject to the same duties and
obligations as if the said professorship had been included in Statute I., to
Statute XCV. of University College, Cork.
- The part-time Professorship of Mathematical Statistics referred to
in this Chapter shall be abolished should the first holder of the post die or
should he retire, resign or be removed from the office.
CHAPTER VI.
Professorship of Statistics
- There shall be established in the College, in the event of its
institution by the National University of Ireland, a Professorship of
Statistics.
- The said professorship shall be a full-time office within the meaning
of the statutes of the College and of the University. The stipend of the
professorship shall be the same as that provided in Chapter I., section 5(a) of
this Statute. The provisions of Statute LXVII., Chapter IV., as amended, shall
also apply to the office.
- The duties of the professor shall be to lecture in Statistics for all
degrees, diplomas and certificates of the University and for all diplomas and
certificates of the College. He shall also examine in Statistics for the
College, and, if required by the Senate to do so, for the University.
- The said professorship shall be a pensionable office to which the
provisions of Statute LXXIX., as amended, and the Pension Scheme annexed
thereto, as amended, shall apply.
- The said professorship shall be tenable for the same term and upon the
same conditions and the holder thereof shall be subject to the same duties and
obligations as if the said professorship had been included in Statutes I. to
XCV. of University College, Cork.
- All references to the "Professor of Statistics" in Statutes I. to XCV.
of University College, Cork, shall henceforth be deemed to be references to the
Professorship hereby established.
CHAPTER VII.
Officers of the College
Statute I., Chapter XIX., section 1, is hereby amended by the deletion
therefrom of the words "a Secretary" and by the substitution therefor of the
words "a Finance Officer and Secretary, a College Engineer and Planning
Officer, a Dean of Student Affairs".
CHAPTER VIII.
Registrar
- With the consent of the present holder the part-time office of
Registrar referred to in Statute I., Chapter XX., and subsequent Statutes shall
henceforth be deemed to be a full-time office. The term "full-time" in this case
shall not be interpreted as precluding the holder of the office of Registrar
from holding and receiving a stipend from the College in respect of a part-time
professorship in the College.
- The annual stipend of the Registrar shall be the same as that provided
in Chapter I., section 5.(a) of this Statute. The present holder of this office
shall also he entitled to residence, fuel and light, valid for pension purposes
at £672 per annum, The provisions of Statute LXVII., Chapter IV., as amended,
shall also apply to the office.
- The full-time post of Registrar shall be a pensionable office to which
the provisions of Statute LXXIX., as amended, and the Pension Scheme annexed
thereto, as amended, shall apply.
- On the coming into operation of this Statute the then holder of the
part-time office of Registrar shall become and shall be deemed to be the first
holder of the full-time office of Registrar.
- The Registrar shall keep the Registers of the College in such a manner
and subject to such directions as may be prescribed.
- He shall act as secretary to the Academic Council of the College,
issue under the direction of the President to each member of the Academic
Council the summons for its meeting, and prepare and maintain a record of the
transactions of the Academic Council.
- He shall carry on under the direction of the President the
correspondence of the College so far as it relates to Academic matters.
- He shall prepare, under the direction of the Academic Council,
programmes of all Examinations.
- He shall carry out the instructions of the Governing Body and of the
Academic Council, in such reasonable ways as the Governing Body and Academic
Council shall respectively prescribe, for the conduct of the general academic
business of the College including the maintenance of discipline and good conduct
of the students.

- (a) He shall, when required by the President or the Governing
Body, prepare official documents of the College and shall preserve copies of the
same.
- (b) He shall preserve all books, records or documents committed to his
care by the President or the Academic Council and all such muniments, records,
writings and documents as may be entrusted to him.
- (c) He shall not allow any books, records or documents committed to his
care to be removed by any person without the written permission of the President
or of the Governing Body, or to be read or inspected by any person other than
the President, a member of the Governing Body, or of the Academic Council,
without the written permission of the President, or of the Governing Body, or of
the Academic Council.
- (d) He shall observe due secrecy with respect of all his official
matters.
- He shall do all such other acts and perform all such other duties in
relation to the College as, by the Statutes or Regulations, the Registrar may be
required to perform.
- The provisions of Statute I., Chapter XX., are hereby replaced by the
provisions contained in this Chapter. Any references in Statutes I. to XCV. of
the College to the office of Registrar shall be deemed to apply to the full-time
office of Registrar.
CHAPTER IX.
Finance Officer and Secretary
- There shall be established in the College the office of Finance
Officer and Secretary.
- The Finance Officer and Secretary shall be appointed by and be
removable by the Governing Body.
- The said office shall be a full-time office within the meaning of the
statutes of the College. The stipend of the office shall be that provided in
Chapter I., section 6(a) of this Statute. The provisions of Statute LXVII.,
Chapter IV., as amended shall apply to the office.
- The duties of the Finance Officer and Secretary shall be:
- i. to be responsible for managing the College finances in accordance
with College Policy as laid down by the Finance Committee.
- ii. to establish, organise and maintain accounting control systems end
records, including budgetary controls, as approved from time to time by the
Governing Body.
- iii. to prepare for the approval of the President, of the Finance
Committee and of the Governing Body the annual finance estimates and reports and
such special financial submissions as may from time to time be required by the
President, the Finance Committee or the Governing Body.
- iv. to collect on behalf of the College all fees from students and
such other sums of money for Collegiate purposes as the Governing Body may call
upon him to collect, as well as any other sums of money owing to the College, to
lodge these and all other sums of money received by the College, as soon as may
be, into the Banking Account of the College and to account for all sums so
received to the Finance Committee and Governing Body.
- v. to be responsible for ensuring that all sums of money owed by the
College be paid, including wages and salaries, rent, rates and taxes, insurance
premiums, payments for goods or services purchased by the College, etc. and to
account for such payments to the Finance Committee and Governing Body.
- vi. to be responsible, under the direction of the President, for the
general organisation of the Administrative and Clerical Staff of the College.
- vii. to act as Secretary to the Governing Body and in that capacity
to be directly responsible to the Governing Body, to the Finance Committee and
to such other committees as may be directed by the President or Governing Body
and to keep a Register of Members of the Governing Body.
- viii. to be responsible for the preservation and safe custody of all
books, records and documents committed to his care by the Governing Body,
Finance Committee or President.
- ix. to observe due secrecy with respect to all his official matters.
- x. not to allow any books, records or documents committed to his care
by the Governing Body or by the Finance Committee or by the President to be
removed without the written permission of the Governing Body or of the
President or to be read or inspected by any person other than a member of the
Governing Body or the President without the written permission of the Governing
Body or the President.
- xi. to carry out under the direction of the President duties in regard
to administrative matters appropriate to the office and other duties appropriate
to the office as may be assigned to him by the Governing Body.
- The said office shall be a pensionable office to which the provisions
of Statute LXXIX., as amended and the Pension Scheme annexed thereto, as
amended, shall apply.
- Statute LVI., Chapter IX., section 3, is hereby deleted.
- Chapter XXI. of Statute I., is hereby revoked and the office of
Secretary and Bursar established thereby is hereby extinguished. Any reference
in Statutes I. to XCV., to the office of Secretary or of Secretary and Bursar
subject to Section 6 of this Chapter shall be deemed to apply to the office of
Finance Officer and Secretary hereby established.
CHAPTER X.
College Engineer and Planning Officer
- There shall be established in the College the office of College
Engineer and Planning Officer.
- The College Engineer and Planning Officer shall be appointed by and be
removable by the Governing Body.
- The said office shall be a full-time office within the meaning of the
statutes of the College. The stipend of the office shall be that provided in
Chapter I., section 6 (a) of this Statute. The provisions of Statute LXVII.,
Chapter IV., as amended shall also apply to the office.
- The duties of the College Engineer and Planning Officer shall be:
- i. to be responsible to the Governing Body and the President for the
buildings, grounds, property and associated equipment of the College and to
be responsible for their upkeep, maintenance and adaptation and for the
preparation of preventive maintenance schedules and the maintenance of the
College services including water, electricity, gas and sanitation, fire
prevention and firefighting.
- ii. to be responsible, under the direction of the President, for
the general organisation of the College Services Staff, Maintenance Staff and
Grounds Staff and to ensure the security of the College premises and property
and the adequate cleaning and upkeep thereof.
- iii. to participate in and supervise the preparation of College
development plans, including the periodic review of such plans, and the
preparation of briefs for the accommodation to be built as well as co-ordination
of the activities involved in the implementation of the plans, the preparation
of the schedules, cost estimates and drawings for the buildings and the
operation of cost control procedures.
- iv. to maintain building records, plans and papers as well as an
inventory of equipment and furniture in the College and to provide such
appropriate reports, information and advice as may be required by the President
or the Governing Body; he shall not allow any records, plans or papers committed
to his care by the Governing Body or by any of its Committees or by the
President to be removed without the written permission of the Governing Body or
of the President or to be read or inspected by any person other than a member of
the Governing Body or the President without the written permission of the
Governing Body or the President.
- v. to carry out under the direction of the President duties in regard
to administrative matters appropriate to the office and other duties appropriate
to the office as may be assigned to him by the Governing Body.
- The said office shall be a pensionable office to which the provisions
of Statute LXXIX., as amended, and the Pension Scheme annexed thereto, as
amended, shall apply subject to the provisions of section 6 of this Chapter. The
holder of said office shall, subject to good conduct and the due fulfilment of
the duties of his office, be entitled to hold office until he shall have
attained the age of sixty-five years; after attaining that age he may be
continued in office by the Governing Body from year to year for a period not
exceeding five years.
Provided that such further continuance in office is recommended to
the Governing Body by the President.

- The provisions of Statute LXIV., Chapter VIII., section (d) shall apply
to this office.
CHAPTER XI.
Dean of Student Affairs
- There shall be established in the College the office of Dean of
Student Affairs.
- The Dean of Student Affairs shall be appointed by and be removable by
the Governing Body.
- The said office shall be a full-time office within the meaning of the
statutes of the College. The stipend of the office shall be that provided in
Chapter I., section 6(a) of this Statute. The provisions of Statute LXVII.,
Chapter IV., as amended, shall also apply to the office.
- The duties of the Dean of Student Affairs shall be:
- i. to co-ordinate and administer all approved services, other than
those of an academic nature and as determined by the Governing Body, for
students of the College, and to make proposals for improvements in the
operation of such services and their possible development
- ii. to operate in consultation with the President an approved
information service both within the College and between the College and the
public.
- iii. to be responsible for the preservation and safe custody of all
books, records and documents committed to his care by the Governing Body, by any
of its Committees or by the President; he shall not allow any books, records or
documents committed to his care by the Governing Body or by any of its
Committees or by the President to be removed without the written permission of
the Governing Body or of the President, or to be read or inspected by any
person other than a member of the Governing Body or the President without the
written permission of the Governing Body or the President.
- iv. to carry out under the direction of the President duties in regard
to administrative matters appropriate to the office end other duties
appropriate to the office as maybe assigned to him by the Governing Body.
- The said office shall be a pensionable office to which the pro- visions
of Statute LXXIX., as amended, and the Pension Scheme annexed thereto, as
amended, shall apply subject to the provisions of section 6 of this Chapter. The
holder of said office shall, subject to good conduct and the due fulfilment of
the duties of his office, be entitled to hold office until he shall have
attained the age of sixty-five years; after attaining that age he may be
continued in office by the Governing Body from year to year for a period not
exceeding five years.
Provided that such further continuance in office is recommended to
the Governing Body by the President.
- The provisions of Statute LXIV., Chapter VIII., section (d) shall apply
to this office.
CHAPTER XII.
Lectureship in Medicine No. 3
- There shall be established in the College, in the event of its
institution by the National University of Ireland a Lectureship in Medicine No.
3.
- The said lectureship shall be a full-time office within the meaning of
the statutes of the College and of the University. The term "full-time" in this
case shall not be interpreted as precluding the holder of the lectureship from
holding and receiving a stipend wholly in respect of a full-time appointment of
the kind specified in section 6 of this Chapter. He shall, however, be
precluded from engaging in private practice or consultations in any form or
retaining any fees which may be received by him in connection with his work.
- The stipend of the lectureship shall be the same as that provided in
Chapter I., section 8(d) of this Statute. The provisions of Statute LXVII.,
Chapter IV., as amended, shall also apply to the office.
- The said lectureship shall be a pensionable office to which the
provisions of Statute LXXIX., as amended, and the Pension Scheme annexed
thereto, as amended, shall apply.
- The duties of the lecturer shall be to lecture in Medicine under the
direction of the Professor of Medicine for all degrees, diplomas and
certificates of the University and for all diplomas and certificates of the
College. He shall also examine in Medicine for the College and, if required by
the Senate to do so, for the University. He shall, in addition, discharge such
other duties appropriate to the office as shall be assigned to him by the said
Professor of Medicine.
- The said lectureship shall be tenable only by a member of the medical staff of the teaching hospital recognised by the College and the University in which the Professor of Medicine has, as of right, the control of an adequate teaching or professional unit of beds, both male and female, and is the medical practitioner in charge, and when the holder of the lectureship has been appointed to assist him.
- The lectureship established in this Chapter shall be tenable for the same term and upon the same conditions and the holder thereof shall be subject to the same duties and obligations as if the said lectureship had been included in Statutes I. to XCV. of University College Cork.
- Statute XXVI., Chapter II., as already amended, is hereby further amended by the addition to the Faculties of Arts, Science and Commerce of the subject Mathematical Statistics.
- This Statute shall be construed with and as part of Statutes I. to XCV. of University College, Cork and may be cited as Statute XCVI. of University College, Cork or Stat. XCVI. of Univ. Coll. Cork.
- This Statute shall come into operation on the twenty-ninth day of November, 1973.
