Statute XXII.
Irish Universities Act, 1908
University College, Cork
We, the Governing Body of University College, Cork, under
and by virtue of the powers in that behalf conferred on us by
the said Act, Do by this present instrument under the Seal
of University College, Cork, make the Statute contained in
the Schedule hereof for the general government of the said
College.
Given under the Common Seal of University College, Cork, this twenty-ninth day of May, One thousand nine hundred and twenty-eight.

CHAPTER I.
ELECTION OF THE MEMBERS OF THE GOVERNING BODY.
Election by the Graduates.
All references to the Election by the Graduates in (c) Chapter
VI., Statute 1., are hereby revoked and the following shall be
read in lieu thereof:-
- The election by the Graduates of the Members of the
Governing Body whom the Graduates are entitled to elect shall
be at a Meeting, hereinafter called the Election Meeting specially
called by the President for that purpose. Such Election Meeting
shall be held on a day appointed by the President which shall
be not more than two months or less than fourteen days before
the date at which the Governing Body then in being shall go
out of office. The President, or his Deputy, or the Acting-President, as the case may be, or in the absence of all of them,
the Registrar shall be the Chairman at such Election Meeting.
- At least twenty-eight days' notice of the Election Meeting
shall be given by the Registrar.
- To be eligible for election a candidate must he nominated
by a Nomination Paper signed by two Graduates of the University
who are members of the College, which shall be lodged with the
Registrar at least twenty-one days before the Election Meeting.
The candidate must be a Graduate of the University, who is
a Member of the College.
- If a candidate who is nominated at an election by the
Graduates of the University who are Members of the College,
is not one of those Graduates, the nomination shall be invalid
and null.
- If at any such election no more persons are validly nominated as candidates for election than the number of persons
which the Graduates are entitled to elect, the candidates so
nominated shall be deemed to be elected, and shall be declared
by the Chairman of the Election Meeting to be elected accordingly. If more candidates shall be nominated than the Graduates
of the University who are Members of the College are entitled
to elect, there shall be a poll.
- At the election by the Graduates the poll shall be taken
by Voting Papers marked and sent or delivered to the Scrutineers
in accordance with the provisions of the following Sections:-
- For the purpose of such election, as soon as may be after
the time for lodging Nomination Papers shall have expired, the
Registrar shall prepare and shall send by post, not less than ten
days before the Election Meeting to each registered Graduate
a Voting Paper containing in dictionary order the names of
all candidates validly nominated for election by the Graduates.
- Such Voting Paper shall he accompanied by a printed
paper of instructions which shall contain the following:-
- (a) A direction to the Voter to place an "X" opposite the
name of the person or persons for whom he votes, a
direction as to the signing of the Form of Declaration
of Identity and the use of the Envelopes ; and if he
desires to vote without being present at the Election
Meeting to post the Voting Paper to the Registrar at
the College in sufficient time for it to arrive in the
ordinary course of post before the Election Meeting.
- (b) A Statement of the names of the Graduates nominating
each person nominated, and
- (c) A Statement of the number of persons for whom the
Graduate is entitled to vote.
- The Voting Paper shall also he accompanied by :-
- (a) Two envelopes one of which is to bear on the outside
the words " Voting Paper " and the other the name
and address of the Registrar and the word " Election."
The envelope containing the above and addressed to
the Voter shall bear the words:- "To be retained and
shown to Witness of Declaration of Identity."
- (b) A Declaration of Identity which shall be in the following form :-

of which I now produce) were intended.

- The Declaration of Identity shall be signed by :-
- (a) If within Saorstát Éireann, before and by a Minister
of Religion, a member of the Medical or Legal Profession, a University Graduate, a Peace Commissioner
or a Commissioner of Affidavits.
- (b) If within Great Britain or Northern Ireland, before
and by a Minister of Religion, a member of the Medical
or Legal Profession, a University Graduate, a Justice
of the Peace or a Commissioner of Affidavits.
- (c) If in any other place, before and by a Minister of Religion.
a member of the Medical or Legal Profession, a
University Graduate, or any person authorised to
administer oaths.
- Subject to the provisions of Sections 17 and 18, the
votes for the Election of Members of the Governing Body by
the Graduates shall be the votes of the Graduates of the University who are registered as Members of the College present
at the Election Meeting given by Voting Papers accompanied
by a Form of Declaration of Identity and banded to the Scrutineers at the Election Meeting together with such Votes of
Members not present at the Election Meeting as shall have been
validly given by Voting Papers and returned by Post with a
Declaration of Identification to the Registrar, and received
by him at the College before the commencement of the Election
Meeting.
- Not less than three days before the day of the Election
Meeting the President or in his absence his Deputy, or the
Acting-President, as the case may be, shall appoint three registered Graduates to be Scrutineers.
- It shall not be necessary that any greater number of
the Graduates who are registered as Members of the College
than two shall be present at the Election Meeting.
- At the Election Meeting of the Graduates the Registrar
shall deliver unopened to the Scrutineers, or in their absence
to the Chairman of the Election Meeting, such of the envelopes
which he lies received as bear on the outside the word " Election."
- If any envelopes have been received by him which do
not bear such word "Election" and have been opened by him,
he shall deliver the envelope marked " Voting Paper " and the
accompanying form of Declaration of Identity to the Scrutineers
and those Graduates present at the Election Meeting who have
not forwarded to the Registrar Voting Papers shall, during the
Meeting hand to this chairman their Voting Papers enclosed
in the envelope marked "Voting Paper " together with the
Declaration of Identity duly completed.
- The fact that an outer envelope sent to the Registrar
did not bear the word " Election" on the outside shall not
vitiate the vote.
- At such Election Meeting any Graduate present whose
Voting Paper shall not have been received by the Registrar before
the commencement of the Election Meeting, who shall give to the
Scrutineers evidence satisfactory to them of his identity, and
of his having sent his original Voting Paper to the Registrar
or of his having lost or spoilt it, shall obtain from the Registrar
a Paper marked with the words " Duplicate Voting Paper,"
stud also a Form of Declaration of Identity marked with the
word " Duplicate."
- If before the termination of the Election Meeting such
Graduate procures such duplicate Voting Paper with the duplicate Declaration of Identity Form to be duly completed, as
required in the case of an original Voting Paper, he may hand
the same to the Scrutineers who shall count such vote with the
original Voting Papers; but in case an original Voting Paper
issued to any Graduates who shall have obtained a duplicate
Voting Paper shall be received by the Scrutineers, they shall
count the original Voting Paper only.
- The Scrutineers shall examine and shall count the votes,
and in any case of doubt as to the validity of a vote, shall
determine the same. The decision of this Scrutineers or the
decision of the majority of them shall be final.
- They shall report in writing to the Chairman of this
Election Meeting the result of the voting ; and if they are
equally divided as to the validity of any vote, the question shall
be determined by the Chairman at the Election Meeting.
- The Chairman shall declare the persons who have
obtained the greatest number of lawful votes, not exceeding the
number of persons whom the Graduates of the University who
are Members of the College are entitled to elect, to have been
duly elected as Members of this Governing Body.
- In case there shall be an equality of lawful votes, for
two or more persons, and the number of persons who have
obtained a greater number of lawful votes together with the
number of persons having an equality of lawful votes shall be
greater than this number of persons whom the Graduates of
the University who are Members of the College are entitled to
elect, this election as between the persons having such equality
of votes shell tie determined by the casting vote of this Chairman
at the Election Meeting.
- The Chairman shall declare the person or persons whose
election has been so determined, with any other person who had
obtained a greater number of lawful votes, to be duly elected.
- Immediately after any such election the Registrar or
other proper officer of the College shall give notice thereof to
the Secretary or other proper Officer of the College.
- For this purposes of this Chapter "the Registrar" shall
mean the Registrar of the College or other proper officer,
- Chapter 1, of Statute to XXI. is hereby revoked.
- Section 2, Chapter IV. of Statute XXI. in so far as the
Lectureship in Hygiene and Public Health is thereby created,
is hereby revoked to the intent that the said Lectureship shall
cease to exist as from this 25th day of May, One Thousand
Nine Hundred and Twenty-Eight.
- There shall be in the College in the event of such Professorship and Lectureships being instituted within the College
by the Senate of the National University of Ireland, the following
Professorship and Lectureships :-
A Professorship of Hygiene and Public Health at a salary
of £150 per annum;
A Lectureship in Public Health at a salary of £50 per annum, and
A Lectureship in Municipal Engineering at £50 per annum.
- The said Professorship and Lectureships shall not be
deemed to be full-time Professorship or Lectureships within
the meaning of the Statutes .
- The said Professorship and Lectureships shall be tenable
upon the same conditions, and the holders thereof shall be
subject to this same duties and obligations as if the said Professorship and Lectureships had been instituted by Chapter XIII.
of Statute I. of University College, Cork.
CHAPTER III.
Date of coming into Operation and Mode of Citation.
- The Statute shall come into operation on the Twenty.
Ninth day of May, One Thousand Nine Hundred and Twenty-
eight.
- This Statute shall be construed with and as part of said
Statutes I. to XXI. of University College, Cork and may be
cited as Statute XXII. of University College, Cork, or Stat.
XXII., Univ. Coll., Cork.
Present when the Common Seal of University College, Cork,
was affixed.
